BILA Virtual Lecture - Digital Assets And The Tertium Quid 24 September 2024, 1.00 pm - 2.00 pm Register your place here https://lnkd.in/eBtk_aMn The explosion of interest in cryptoassets has revived interest in a curious notion in the law of personal property: the tertium quid or personal property that is neither a thing in possession nor a thing in action. This renaissance, however, has not taken into account historical debates over the same or the law’s experience of the same in respect of patents. Once these lessons are properly accounted for, it will be clear that there is nothing to stop the law from treating cryptoassets as things in action and the law can focus on the more important question of what rights said thing in action entails. The Law Commission's proposal to introduce a tertium quid into English personal property law, recently tabled as a Bill in Parliament, brings little clarity to the question of what rights cryptoasset holders actually have but introduces tremendous uncertainty into English personal property more broadly. The reform is built upon clear and obvious misreadings of the slim precedents cited in support and is also contrary to trends in other common law jurisdictions. Professor Kelvin F.K. Low read law at the National University of Singapore and Oxford University. Before his current appointment at the University of Hong Kong, he held previous appointments at National University of Singapore, Singapore Management University, and City University of Hong Kong. His research interest spans the field of private law but with a particular interest in property, broadly defined. He has published internationally with leading journals such as the American Journal of Comparative Law, the International & Comparative Law Quarterly, Legal Studies, Lloyd’s Maritime and Commercial Law Quarterly, the Law Quarterly Review, the Melbourne University Law Review, and the Modern Law Review. He is a co-author (together with Michael Bridge, Louise Gullifer, and Gerard McMeel) of the 2nd and 3rd editions of The Law of Personal Property, and co-author (together with Tang Hang Wu) of the 3rd and 4th editions of Tan Sook Yee’s Principles of Singapore Land Law. His works have been cited by the courts in Australia, Canada, England and Wales, Hong Kong SAR, Malaysia, New Zealand, and Singapore as well as law commissions and law reform bodies in Australia, England and Wales, Ireland, New Zealand, Scotland, and Singapore. Meet the BILA committee Dr Franziska Arnold-Dwyer I have been a member of the BILA Committee since 2019. What I most enjoy about being involved in BILA is the engagement, debate and exchange of information concerning insurance law and practice with colleagues. As the BILA Journal Deputy Editor I receive, review, and edit article submission for the annual BILA Journal. If you have an insurance law-related article or note that you would like to see published in our Journal please get in touch! I am a Senior Lecturer in Insurance Law and the Director of the Insurance Law LLM Programme at Queen Mary University, where I teach Insurance Contract Law, Reinsurance Law, Marine Insurance Law and Insurance Regulation. I am also a qualified solicitor and, before returning to academia, I practised law at Clifford Chance. Whether as a practising lawyer or as a researcher, I have always been fascinated by the many facets of insurance law and by how contractual mechanisms and structures can be used to transfer, allocate and manage risk. My research interests are reinsurance law and the intersection of insurance law and sustainability. I have recently published a book ‘Insurance, Climate Change and the Law’ (Routledge 2024) in which I examine the legal and regulatory issues arising for insurance companies from climate change and the legal frameworks that govern to what extent insurance companies are required or permitted to take climate action. Together with colleagues from insurance companies and academia from around the globe, I am also working on the ‘Principles of Reinsurance Contract Law’ – a framework for reinsurance contracts that aims to enhance contract certainty by creating a uniform frame of reference and uniform legal terminology. Meet the BILA committee Dr Caroline Bell I joined BILA back in 2014 as its Honorary Secretary shortly after completing my PhD on the LMX spiral. I then became the BILA Journal Editor and am now a member of the Committee and the Publicity Sub-committee. I am Head of Wordings at QBE European Operations, leading a team of lawyers who specialise in the review of, and advice on insurance policy wordings and coverage issues across several jurisdictions. I have been in insurance for 25 years starting as a litigator in private practice. I have attended many BILA lectures along the way. Little did I know when I was a junior solicitor sitting at the back of the Lloyd’s Old Library furiously scribbling on my note pad that one day I would be sitting amongst the Committee Members deciding on the topic of the next lecture. I am passionate about the London insurance market and promoting the fantastic career opportunities it offers. BILA is at the heart of the market. It provides its members great networking opportunities with its unique mix of barristers, judges, solicitors, academics, as well as in-house and market professionals (including the LMA & IUA) representing both insureds and insurers. As a result, BILA is never short of speakers on topical issues, often with first hand access to those who have been involved or impacted by a recent legal development. Despite its title, BILA is not just for lawyers. I am glad to see claims handlers, brokers, underwriters and others market specialists attend our talks, and would like to encourage more people to benefit from the excellent range of lectures and journal articles produced by BILA.

10th AIDA Europe Conference | Athens | 30-31 May 2024 BILA and UK-based lawyers were well represented at the 10th AIDA Europe Conference (“The Growing Challenge of Meeting Customer Needs. Quo Vadis, Insurance Market?”) in Athens from 30th to 31st May 2024. Plenary sessions and AIDA Working Party meetings engaged 225 delegates from over 30 countries and featured BILA committee members, Dr Franziska Arnold-Dwyer, Prof. Özlem Gürses and Tim Hardy among the moderators, presenters and panellists. Other UK-based presenters included Dr Kyriaki Noussia of Reading University, Dr Konstantinos Chalkias of Birkbeck University of London, Michelle George and Adrian Mecz of Norton Rose Fulbright and Richard Sarll of 7KBW. The BILA Charitable Trust and Mishcon de Reya were among the valued sponsors. BILA is delighted to congratulate Tim Hardy (L). At the Conference Drinks Reception on the rooftop of the Athens Club, Tim was presented with the AIDA Medal by AIDA World President, Carlos Estebenet (R), for his contribution to AIDA in many roles, including currently AIDA Europe Co-Chair and as Chair of the Climate & Catastrophic Events Working Party, from which he stood down in Athens after 25 successive meetings over a period of thirteen years.
