In July 2024, the European Commission accepted commitments from a pharmaceutical company over concerns about a potential abuse of dominance. The case highlights how spreading false or misleading information about a competitor isn’t just unfair — it can breach competition law. What is disparagement? Disparagement involves unsubstantiated claims, false advertising, or repeated negative statements about competitors that harm their reputation and distort markets. Unlike traditional anti-competitive behaviour, disparagement isn’t always centrally planned — it can stem from off-the-cuff remarks by individual employees, making it tricky to detect and prevent. On 26 December 2023, the UK Government introduced the most significant change in corporate criminal law in decades, aiming to simplify the prosecution of companies.
