    🧭 Addressing disparagement as an abuse of dominant position. Fieldfisher's latest Compliance Compass episode features Jessica Gardner and Borja Martínez Corral as we dive into the competition law risks of disparagement — a growing concern for dominant companies. In July 2024, the European Commission accepted commitments from a pharmaceutical company over concerns about a potential abuse of dominance. The case highlights how spreading false or misleading information about a competitor isn’t just unfair — it can breach competition law. What is disparagement? Disparagement involves unsubstantiated claims, false advertising, or repeated negative statements about competitors that harm their reputation and distort markets. Unlike traditional anti-competitive behaviour, disparagement isn’t always centrally planned — it can stem from off-the-cuff remarks by individual employees, making it tricky to detect and prevent. On 26 December 2023, the UK Government introduced the most significant change in corporate criminal law in decades, aiming to simplify the prosecution of companies. She is a rising star in the derivatives industry and has been the go-to derivatives lawyer for insurance, securitisation, energy and project finance work at A&O over the last 10+ years.
