It has been a busy and successful week, and the weekend is just around the corner! 3 clients, 3 great results: 🏛️ My client was successful in his appeal against sentence for serious sexual offending. The Court of Appeal ultimately agreed that the sentence passed, failed to take into account the previous custodial sentence served in circumstances whereby this complainant came forward after the substantive proceedings had concluded. We also had leave granted from the single judge, and we successfully argued for the matter to be expedited which ultimately left only ~2 months between lodging grounds and the listing of the hearing 🎉 Impossible without the expertise of the fantastic Tara McCarthy of Thomas More Chambers 👨🏻⚖️My client was due to be sentenced for a serious violent disorder whereby another individual was hit over the head with a hammer. Following meticulous mitigation prep, we were able to demonstrate that they was not a ringleader in the disorder, instead the client was highly impressionable and influenced by those around them. A community order was imposed which allowed him to leave court and prepare for the birth of his daughter. Special thanks to stellar counsel, Rebecca Malczewski of 2 Hare Court, Chambers of Jonathan Laidlaw KC ⚖️ A client charged with a series of serious assaults has been given a Suspended Sentence Order by the Magistrates’ Court. I managed to demonstrate to the court that my client’s drug and alcohol consumption at the time of the offending was actually a mitigating reason (usually treated as aggravating), with reference to the particularly tragic circumstances that applied to them. The custody threshold was certainly crossed, with immediate imprisonment justifiable, but my client was released from court with their liberty preserved 🤩 Litigation conducted by my amazing colleague Louise Scott.
