Well, finally, after weeks of speculation The Employment Rights Bill, heralded as the biggest upgrade in employment rights, has been published today, however, it is lacking in detail. Here is what we know so far: - Unfair dismissal rights to be from day 1 but during a probation period of maximum 9 months a shortened dismissal process can be followed - Increased rights for zero hours staff with rights on number of hours and requirement to give notice of shifts - Statutory sick pay to be paid from day one of absence and payable to all staff regardless of salary - Increased protection for pregnant workers and new mothers returning to work - Bereavement leave and parental leave to be a day 1 right - Full liability for employers for third party harassment - Fire and Re-hire practices to be automatically unfair in most situations, except where survival of a business is at risk - Employment contracts to include a statement on union rights - Flexible working to be a default right unless it is ‘unreasonable’ and a requirement for the employer to explain why their refusal is reasonable in writing to the employee - Collective redundancy consultation required where 20 employees are affected across a whole business and not just individual establishments These changes will now be subject to full consultation and may well be amended during that process. It is anticipated that these changes will come into effect in 2026 giving time for preparation, although it's best to get ahead. The government has also published a ‘Next Steps’ document which outlines further reforms to employment law including a ‘right to switch off’, a change to a single status of worker, a review of parental leave and carers leave and an obligation to report on ethnicity and disability pay gap. The polls are now closed and with the exit polls showing a Labour landslide, changes in employment law as outlined in the Labour manifesto are likely to be legislated in. Labour’s aim is to strengthen worker rights and wellbeing to create a fairer working environment for all employees, across all social classes. This will mean changes for you and your business, but how? What are the Key Policies? Around 60 changes are proposed, with most likely to be implemented quickly. The Labour party have stated that they want to implement this legislation within 100 days of entering government and the Sailsbury convention 1945 means that the House of Lords does not have the right to veto or delay policies that are included in the governing party’s manifesto. With a significant focus on Day One rights to an employee you and your business will need to be aware of the following key policies which will change: · The banning of ‘exploitative’ zero hours contracts – although how ‘exploitative’ is defined will be key. · Basic Day One Rights for all workers ending the requirement for 2 years’ service for claims against unfair dismissal with probationary periods taking on a new significance in this regard. · Statutory Sick Pay payable immediately from first day of absence coming at an extra cost to your business. · Family friendly rights to be extended – including enhanced protection for maternity returners, extending statutory maternity and paternity leave, parental leave as a day one right and bereavement leave from day one. · Flexible working to be a default right – from day one of employment and the introduction of the right to switch off. · Changes to minimum wage - Altering the criteria for determining national minimum wage to include consideration of cost of living and removing age bands, so all adults are entitled to the same minimum wage. · A Ban on The Practice Of ‘Fire and Rehire’ - strengthening information and consultation procedures and adapting unfair dismissal and redundancy legislation to prevent workers being dismissed for not agreeing to less favourable contract terms. · Enhancing the role of trade unions - simplifying the process of union recognition, strengthening the protections for trade union reps, and introducing a new duty on employers to inform the workforce of their right to join a union. Remember… these changes will become the law, HR professionals will have a busy rest of the year, choosing how to adapt to these policies in the most appropriate way for differing businesses in differing circumstances. For the last 3 years Highlight People have been proud sponsors of the Faringdon Rugby Club Women's and girls teams. In that time we have gone from 7 women attending the very first inner warrior introductory session to a touch and contact team for women and our amazing, and growing, girls team. These girls demonstrate such positivity and resilience and just get stuck in growing physically, mentally and, the most important bit, having fun! That's a wrap on this season and I can't wait to see what the next season brings! This is the girls last night at their last session getting muddy and warming up with a well deserved BBQ with their coaches Chris Ellacott and Anthony Cook. I might need to reconsider if white is a good background colour on our logo! A massive thanks to all those at the club who work tirelessly to promote grassroots sport in our town - you're amazing!
