    𝐒𝐭𝐫𝐞𝐧𝐠𝐭𝐡𝐞𝐧𝐢𝐧𝐠 𝐠𝐫𝐞𝐞𝐧𝐰𝐚𝐬𝐡𝐢𝐧𝐠 𝐫𝐞𝐠𝐮𝐥𝐚𝐭𝐢𝐨𝐧𝐬: 𝐅𝐂𝐀’𝐬 𝐧𝐞𝐰 𝐫𝐮𝐥𝐞𝐬 𝐚𝐧𝐝 𝐢𝐭𝐬 𝐚𝐥𝐢𝐠𝐧𝐦𝐞𝐧𝐭 𝐰𝐢𝐭𝐡 𝐄𝐔 𝐝𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞𝐬 🌍 On May 31, 2024, the FCA introduced an anti-greenwashing rule as part of its Sustainability Disclosure Requirements (SDR) to identify and challenge misleading sustainability claims, complementing the EU’s directives. This follows notably the ban on green claims by the Advertising Standards Authority against several entities such as BMW, MG, and Transport for London. 𝐅𝐂𝐀’𝐬 𝐥𝐚𝐭𝐞𝐬𝐭 𝐫𝐮𝐥𝐞: 1. 𝐀𝐩𝐩𝐥𝐢𝐜𝐚𝐛𝐢𝐥𝐢𝐭𝐲 𝐚𝐧𝐝 𝐬𝐜𝐨𝐩𝐞: Applies to all FCA-authorized firms communicating with UK clients or promoting financial products/services in the UK. Covers a wide range of communications, including statements, strategies, targets, policies, information, and promotional materials. 2. 𝐑𝐞𝐪𝐮𝐢𝐫𝐞𝐦𝐞𝐧𝐭𝐬: - 𝘍𝘢𝘪𝘳, 𝘤𝘭𝘦𝘢𝘳, 𝘢𝘯𝘥 𝘷𝘦𝘳𝘪𝘧𝘪𝘢𝘣𝘭𝘦: Claims must match actual sustainability characteristics, be clear, not misleading, and capable of being substantiated. - 𝘛𝘳𝘢𝘯𝘴𝘱𝘢𝘳𝘦𝘯𝘵 : Information must be clear, complete, without omissions, and consider the full life cycle of the product/service. - 𝘔𝘦𝘢𝘯𝘪𝘯𝘨𝘧𝘶𝘭 𝘤𝘰𝘮𝘱𝘢𝘳𝘪𝘴𝘰𝘯𝘴: Comparisons to other products/services must be fair and meaningful. 3. 𝐈𝐦𝐩𝐥𝐢𝐜𝐚𝐭𝐢𝐨𝐧𝐬 𝐟𝐨𝐫 𝐜𝐨𝐦𝐩𝐚𝐧𝐢𝐞𝐬: - Fines, operational restrictions, or prohibitions; mandatory withdrawal of misleading communications/documents; increased litigation risk if the FCA’s "naming and shaming" policy is implemented; 𝐩𝐮𝐛𝐥𝐢𝐜 𝐢𝐝𝐞𝐧𝐭𝐢𝐟𝐢𝐜𝐚𝐭𝐢𝐨𝐧 𝐨𝐟 𝐟𝐢𝐫𝐦𝐬 𝐮𝐧𝐝𝐞𝐫 𝐢𝐧𝐯𝐞𝐬𝐭𝐢𝐠𝐚𝐭𝐢𝐨𝐧 𝐞𝐯𝐞𝐧 𝐰𝐢𝐭𝐡𝐨𝐮𝐭 𝐞𝐧𝐟𝐨𝐫𝐜𝐞𝐦𝐞𝐧𝐭 𝐚𝐜𝐭𝐢𝐨𝐧. 𝐄𝐔’𝐬 𝐥𝐚𝐭𝐞𝐬𝐭 𝐝𝐢𝐫𝐞𝐜𝐭𝐢𝐯𝐞: Entered into force on March 27, 2024, amending the Consumer Rights Directive and the Unfair Commercial Practices Directive. 1. 𝐒𝐜𝐨𝐩𝐞: Misleading commercial practices include false information about a product's reparability or recyclability; environmental claims must be backed by verifiable commitments and targets, regularly verified by an independent third-party expert; prohibits the use of sustainability labels not based on a certification scheme or not established by public authorities. 𝐃𝐢𝐟𝐟𝐞𝐫𝐞𝐧𝐜𝐞𝐬 𝐛𝐞𝐭𝐰𝐞𝐞𝐧 𝐭𝐡𝐞 𝐔𝐊 & 𝐄𝐔 𝐫𝐞𝐠𝐮𝐥𝐚𝐭𝐢𝐨𝐧𝐬 - The FCA’s rule applies specifically to FCA-authorized firms, while the EU’s regulations apply to all traders marketing products to EU consumers. -The EU regulations include specific bans on certain types of claims and require the use of approved certification schemes or public authorities for sustainability labels, which is not explicitly mentioned in the FCA’s rule.     The countdown has started! Only a few days to go until the DLA Piper Milan Investment Arbitration Pre-Moot at our Milan offices on 10 and 11 May 2024.   Don’t miss the opening conference “ESG and investment protection: the pursuit of a delicate balance through third-party funding?” on Friday morning, 10 May 2024, at 9:30 am. After a welcome from David Maria Marino, Stefano Modenesi and Federica Bocci, Professor Pietro Franzina (Università Cattolica di Milano) will give his keynote speech on "The changing face of investment arbitration: some key trends." Federica Bocci will moderate a panel on "The role of investment arbitration to adjudicate ESG disputes." It will include presentations and talks by Professor Luigi Crema (Università degli Studi di Milano), Jorian Hamster and Irene Petrelli (Curtis, Mallet-Prevost, Colt & Mosle LLP). A further panel on "Third-party funding and ESG disputes: is there a point of connection?" moderated by Stefano Modenesi, will feature presentations and talks by Alice Fremuth-Wolf (Nivalion), Roslyn L. (No Impunity) and Alessandro Boso Caretta.   After a Q&A session, Federica Bocci and Giulia Vallar will make the concluding remarks.   The conference will be followed by multiple rounds of hearings in the afternoon of Friday, 10 May 2024, and on Saturday morning, 11 May 2024, with several university teams from different countries honing their skills before the annual Frankfurt Investment Arbitration Moot Court (FIAMC).   Registrations for the conference are still opened!     𝗡𝗲𝘄 𝗖𝗮𝘀𝗲 𝗟𝗮𝘂𝗻𝗰𝗵 𝗼𝗻 𝘁𝗵𝗲 𝗡𝗼 𝗜𝗺𝗽𝘂𝗻𝗶𝘁𝘆 𝗣𝗹𝗮𝘁𝗳𝗼𝗿𝗺: 𝗦𝗲𝗲𝗸𝗶𝗻𝗴 𝗝𝘂𝘀𝘁𝗶𝗰𝗲 𝗶𝗻 𝗘𝗮𝘀𝘁𝗲𝗿𝗻 𝗖𝗼𝗻𝗴𝗼 No Impunity, in collaboration with Femmes pour la Paix et les Droits Humains (FPDH), is proud to announce the launch of a significant legal case against Twangiza Mining, a subsidiary of Banro Corporation. This case addresses the profound impacts of industrial gold mining operations on South Kivu communities. Twangiza Mining has been running gold mining operations since 1997. Covering an area of 1,164 km² in the Luwindja and Burinyi chiefdoms, the company's activities have led to environmental degradation, including deforestation, erosion, and water contamination with toxic chemicals like cyanide. This pollution has adversely affected both the ecosystem and the wildlife. The social impacts of Twangiza Mining's operations include the loss of ancestral lands and cultural sites, negatively affecting the communities' social well-being. Legal action is being initiated by Femmes pour la Paix et les Droits Humains on behalf of the affected communities. We have been working directly with FDPH to bring their case to our platform. We got put in touch by Business & Human Rights Resource Centre and first met with them a few months ago. After hearing the stories of the Luwindja and Burinyi communities, we knew we had to take action. This is the third case we are launching on the No Impunity platform and it is also our second philanthropic case. This means that, unlike our investment cases, the FDPH case is raising funds via a donation model. Our platform ensures that organizations like FDPH can seamlessly upload case metrics and evidence - it automatically structures cases, organizes documentation and provides litigation groups with reporting, monitoring and case management tools.  While our primary focus is on building a strategic litigation platform for litigation investors, we think it is crucial that we utilize our platform for philanthropic endeavours, whenever we can. By supporting this case, you are not just funding a legal battle, you are supporting the restoration of dignity and the right to a safe environment for the communities of South Kivu.     Finishing our #GenZ #founders series with a bang, today we profile four young businesses setting out to make the world a better place. They include: 💥 Anahita Laverack, who co-founded Oshen, which makes autonomous micro vessels for ocean data collection, with Ciaran Dowds, after meeting at Imperial College London. The pair have raised more than £100,000 in angel investment and around £400,000 in grants and employ a team of five in Plymouth. Their backers include: Department for Environment, Food and Rural Affairs and European Space Agency - ESA. 💥 Zeezy Qureshi, the founder and CEO of Motion, a platform to deliver fun, chair-based activity and exercise sessions in care homes. The company has raised £130,000 in grant funding, including from Innovate UK, and employs five at its HQ at Sheffield Technology Parks. The team has worked with more than 2,500 older adults in more than 60 care homes. 💥 Conor Walsh, founder of ReelHelp which makes tools to make electricians' lives easier. He explained how mentors have helped him. "All you need is people around you to tell you that you can do anything... then you start believing it," said Walsh, who previously won a spot on the prestigious Royal Academy of Engineering's regional talent engines programme. 💥 Aurélia Le Frapper, co-founder of No Impunity, a legal tech start-up launched in 2022, with the goal of making the justice system more accessible to all, irrespective of financial status of background.
