As is somewhat traditional I will also be on the Q&A panel at the end, trying to (i) sound like I know what I am talking about or (ii) passing the buck! The ACL working party consists of: •Kris Kilsby – ACL Council – chairing member •Julian Caddick – ACL Council – chairing member •Kevin Latham – Kings Chambers and Deputy Costs Judge •Erica Bedford – Kings Chambers and Deputy Costs Judge •Dr Victoria McCloud – Former SCCO Deputy Costs Judge and former salaried KBD Master •David Wright – Irwin Mitchell •John Pennington – Clyde & Co •Mark Byrne – Crown Costs •Ben Petrecz – Partners in Costs •Jonathan Lord – Weightmans •Liz Friston – Phoenix Legal Services The working party will present discussions and suggestions to date at the ACL London conference tomorrow, while also surveying attendees on the Detailed Assessment process itself. A full update will follow ahead of a formal consultation amongst ACL members, along with a Townhall style virtual meeting if required. This will formulate the submission of a formal proposal to the SCCO/CPRC later this year. During 2025 the group intend to create and issue a ‘best practice’ guide to be shared with both ACL members and the judiciary.
A Case Study on the Henderson Rule and Costs Implications. Rebecca Humble, one of our Costs Lawyers, takes a look at the case Orji & Orji v Nagra & Nagra [2023] EWCA Civ 1289. The judgment in this case explores the application of the Henderson v Henderson rule in the context of striking out claims, with a particular focus on the costs implications caused by procedural issues. This case illustrates how courts balance claims of abuse of process and cost management with ensuring that justice is served fairly, especially in light of delays.
