Bochner PLLC is proud to announce a major victory for Edward Paltzik and our Constitutional Law Group!   The case is Hunter et al. v. Cortland Housing Authority, 5:23-cv-01540, Northern District of New York.    Last week, Judge Glenn T. Suddaby of the United States District Court for the Northern District of New York approved a permanent injunction which overturns Cortland Housing Authority’s former ban on possession of firearms in government-funded apartments.    With the entry of this injunction, tenants are now permitted to own and possess firearms within their residences, engage in lawful self-defense and defense of others in common areas, and transport firearms to and from their residences.    The injunction mandates that Cortland Housing Authority and its administration must ensure that all future versions of the lease comply with the Second Amendment “in all respects” and further restricts the defendants from censoring the speech of any person on their social media.    Finally, the defendants are required to pay the plaintiffs’ attorneys fees incurred during the litigation. Bochner PLLC is proud to announce a significant success for our client, Dr. Wiesel, in his fight to enforce his #patent rights against Apple.    Dr. Wiesel’s patent covers life-saving technology that detects atrial fibrillation through pulse rhythm, which Apple unlawfully used in their Apple Watch without a license.   Despite Apple’s numerous attempts to challenge the validity of the patent and delay litigation, our team—Serge Krimnus, Paul Fraulo, Erik Dykema, and Laura Harper—successfully defended the patent at every step, including a recent win overcoming an examiner's rejection on appeal to the #PTAB which summarily decided in favor of Dr. Wiesel, ending the reexamination process.   We remain committed to enforcing Dr. Wiesel’s rights as the case continues.
