A blog post by Pillsbury Winthrop Shaw Pittman LLP partner Reza Zarghamee and associate Lauren Johnstone informs that the Environmental Protection Agency (EPA) has announced an eight-month delay in the reporting periods for the PFAS Reporting Rule under Section 8(a)(7) of the Toxic Substances Control Act (TSCA). The compliance date has been shifted from April 2024 to November 2024. This extension provides companies additional time to prepare for the new reporting requirements. The first reporting period, initially set to begin in April 2025, will now commence in November 2025. The Environmental Protection Agency (EPA) has introduced new rules for reporting information about certain stationary engines, which are often used for backup power and other support functions. These changes were published on August 30, 2024. 💻 Electronic Reporting: If you own or operate stationary engines that fall under specific regulations, you must now submit certain reports electronically through the EPA’s online system. This includes initial compliance notifications, performance test reports, compliance status updates, and annual or semiannual compliance reports. 📅 Extensions for Reporting: The EPA can grant extra time for submitting electronic reports if the EPA’s system is down or in case of unavoidable events like natural disasters, terrorism, or equipment failures. National Security: For engines owned or operated by federal defense agencies, if revealing the exact location of the engine poses a security risk, those details can be omitted from the report. ⌚ 50-Hour Emergency Operation: The rule maintains the current allowance for emergency engines to run up to 50 hours per year to help prevent power outages. Although EPA received comments on this provision, no changes were made at this time. They are still considering the feedback received. These new rules are effective immediately from August 30, 2024. The EPA’s goal is to make compliance reporting easier and more efficient while allowing some flexibility for emergencies and national security concerns.
