RTX, the parent company of Raytheon, agreed to pay $200 million in fines and remediation to address hundreds of export control violations that led to the disclosure of sensitive military secrets. The consent agreement between RTX and the U.S. Department of State, resolves 750 violations of the Arms Export Control Act and the International Traffic in Arms Regulations by Raytheon and several subsidiaries that occurred from 2017-23. RTX self-disclosed the violations, cooperated with the investigation, and implemented remediation for “numerous” compliance deficiencies to address many of the issues uncovered during the investigation, the State Department said. As part of its remediation plan, RTX will hire a special compliance officer to oversee the consent agreement. The U.S. Department of Justice (DOJ) declined to prosecute Boston Consulting Group (BCG) for allegedly bribing Angolan officials in violation of the Foreign Corrupt Practices Act (FCPA), citing the firm’s prompt self-disclosure and timely remediation. The DOJ found evidence that BCG’s office in Lisbon, Portugal, gave $4.3 million to an agent in Angola to secure contracts with the Angolan Ministry of the Economy and the National Bank of Angola, according to a letter by Glenn Leon, chief of the DOJ’s Fraud Section, to BCG’s attorneys. BCG agreed to disgorge $14.4 million in profits it secured from the corrupt activity but avoided criminal prosecution despite an agent of the firm sending bribes through three different offshore accounts, the DOJ said. Companies will need to tighten up how they monitor their supply chains after a recent U.K. ruling determined that corporates could be open to money laundering charges if they fail to act in cases where they believe there is a risk of forced labor. In a legal challenge brought by GLAN | Global Legal Action Network and the World Uyghur Congress, the U.K.’s Court of Appeal ruled that companies can be prosecuted under the Proceeds of Crime Act if they know–or suspect–to have imported goods made in criminal circumstances elsewhere in the supply chain, like forced Uyghur labor in China. Lawyers said this is the first time that a U.K. court has decided that ordinary commercial trade could amount to a money laundering offense if there is criminality in the supply chain.
