In a 2024 McKinsey study, 65% of respondents said that their organizations are routinely using generative artificial intelligence (AI) in at least one business function. Clearly, AI is poised to have a significant impact on industries around the globe, offering unprecedented opportunities to enhance efficiency, productivity, and innovation. Corporations can leverage AI to streamline operations, improve decision-making, accelerate research and discovery, and foster a culture of continuous improvement. AI is also changing the way that users interact with content, adding a new layer of complexity to copyright compliance. In the same 2024 McKinsey study, more than half the respondents listed intellectual property infringement as a risk to an organization’s generative AI use. The only risk that ranked higher was inaccuracy of the outputs. At Copyright Clearance Center (CCC), we hear from organizations of all sizes that employees are not always aware of what permissions are needed to use content, and how to obtain them if needed. CCC has supported content users for decades by providing efficient, harmonized licensing solutions that cover their internal uses of content. The Annual Copyright License (ACL) from CCC now includes a harmonized set of rights for the internal-only use of lawfully acquired content with AI systems. The potential applications of AI are vast and varied. When summarizing publications for the development of these documents, we sometimes use figures and tables from the publication. If lifting the figure or graph, we know to seek copyright permission first. Is it the same for tables?" The Stakes Are High: Why I am Tackling AI and Copyright Head-On Picture this: It's the early 1990s, and I'm a young lawyer working for the Federal Government. We're on the cusp of a digital revolution, grappling with the "Information Superhighway" - now known as the Internet. Our burning question then was how copyright law would adapt to this new digital frontier. Fast forward three decades, and here we are again. Now, instead of the Information Superhighway, we're facing an AI revolution reshaping our creative landscape at an unprecedented pace. The questions we're asking today echo those from 30 years ago, but the stakes are even higher. I've spent over three decades ensuring rightsholders get paid when their works are used, primarily at Access Copyright, where I served as President and CEO for the last ten years. Recently, I've taken on a new challenge working with Copyright Clearance Center (CCC) as a consultant and advisor. Why? Because they're taking on one of the biggest issues in our field: Responsible AI for the use of copyrighted materials in training LLMs and AI systems. My passion for this subject stems from first-hand experience. I've witnessed rightsholders struggling while their work is used without permission or compensation. I've also seen AI's incredible potential to revolutionize industries and spark new forms of creativity. Finding a way to balance these interests is about shaping the future of human creativity and innovation. The intersection of AI and copyright presents a complex landscape where digital innovation and intellectual property law converge in unprecedented ways. It's a challenging domain, but undeniably fascinating. CCC believes that innovation requires both a pro-AI and pro-copyright approach. It's not an either-or situation. I share CCC's view on AI's power to drive innovation and creativity but also recognize the irreplaceable value of human creativity and cultural diversity. Rightsholders deserve respect and compensation for their work, ensuring that unique voices and cultural expressions continue to thrive alongside technological advancements. It's a delicate balance, but crucial for the future of both technology and creative industries. I'm contributing to important conversations alongside CCC to help make sense of it all, exploring market developments and critical issues at the intersection of AI, copyright, and licensing. Whether you're a rightsholder navigating this new landscape, a business leader ethically implementing AI, a tech enthusiast understanding AI breakthroughs, or just curious about AI's impact on creativity, there's something here for you.
