Passenger Sexual Assault Litigation (2025 WL 678543) continues to shape the evolving legal landscape surrounding hyperlinked documents in eDiscovery. 🚀 💡 In his insightful article, Michael Berman breaks down the court’s latest decision addressing the treatment of hyperlinked documents, metadata obligations, and evidentiary concerns. While modern attachments—hyperlinked documents stored in cloud platforms—have been the subject of ongoing litigation, this ruling clarifies key disputes arising from Uber’s ESI Protocol, including: 🔹 Hyperlinked Documents as Attachments – The court reaffirmed that hyperlinked cloud-based documents (e.g., Google Drive files) function like traditional email attachments and must be treated accordingly.  🔹 Metadata & Production Feasibility – Uber was required to provide metadata linking hyperlinked documents to emails but was not obligated to produce contemporaneous versions where doing so was technologically infeasible.  🔹 Handling Non-Google Drive Hyperlinks – The court ruled that Uber must provide additional metadata or documents upon request, ensuring relevance while considering technological limitations.  🔹 Email Threading & Evidentiary Challenges – The decision addressed whether hyperlinks in email threads should be treated as attachments, raising questions about usability and admissibility in trial. 📜 Why This Matters:  The ruling highlights the ongoing complexities of handling hyperlinked ESI, reinforcing that metadata preservation, technological capabilities, and evidentiary considerations must be carefully addressed in ESI protocols.
