Arbitration exists by contractual design. For this reason, Barry Ostrager writes in the New York Law Journal, considerable thought should be given to the terms in a contract that provide for the resolution of a dispute by #arbitration. All too often parties insert arbitration clauses that give rise to problems that could be avoided if more thought were given to the drafting of an arbitration clause. Check out this article to learn more about what Judge Ostrager suggests including in your next arbitration clauses. https://lnkd.in/gB7GXZUt

Check out this article by Shira A. Scheindlin Scheindlin from the New York Law Journal. Most consumer contracts require that all disputes be resolved by arbitration and that the employer, seller, or institution will pay the costs of the arbitration. But what happens when 50,000 individual claims are brought for arbitration? She discusses a recent case and breaks down the financial challenges surrounding #massarbitrations and its associated fees. https://lnkd.in/gg6EuZhX
