Lawyers across Florida are being warned about a resurgence of the old cashier’s check scam, with recent reports indicating that arbitrators are the latest targets. The Florida Bar has received accounts from two separate Bar members who were engaged as arbitrators after being approached by what they believed were legitimate clients, only to discover they were victims of con artists. Here's the scam: They provide a well-spun tale of being close to a settlement but engaging an arbitrator to assist them in bringing the dispute to a close. They ‘settle’ a portion of the dispute, which, according to the trust accounting rules, triggers the arbitrator to release the undisputed portion of the funds.
