In a recent case out of the Southern District of New York., the Court addressed a critical issue: how to allocate the costs of data security in eDiscovery. The government, as the receiving party, proposed robust security measures for sensitive medical data, but the producing party argued these were insufficient and sought additional protections. The Court ultimately ruled that these concerns were valid and ordered the government to implement the enhanced security measures at its own expense.
