    #Grateful for the discussion with Heather MacDougall, Esq. and CSP and Trever Neuroth, JD, ASP on the current state of comings and goings of legal #EHS. NexusHSE is fortunate and thankful for their partnership. We discussed the pros and cons of a federal workable heat stress standard, the impacts of Loper and maybe a future Auer, the US Environmental Protection Agency (EPA) and Security Exchange Commission (SEC) rules, what physical therapy may be under the recent Occupational Safety and Health Administration memo, and many other topics. It was great one on one Q and A. "You are the average of the 5 people you spend the most time with - Jim Rohn" is what John Fischer said during the session beginning and we had some really talented people participate! We appreciate his moderation, and he kept the conversation on such a relatable level. Thank you John. Our EHS Legal IQ went way 📈 - all thanks to our presenters and attendees! These are collaborations we hope you won't miss. We believe these NexusHSE discussions and opportunities don't exist which is why we created the company in the first place 😁

Scott Madar Joins NexusHSE🚨 We are excited to announce a new member to the Nexus HSE team.  He is familiar to many of you and has been patiently waiting for the right opportunity to join a world-class team. He looks forward to reconnecting with old colleagues and getting to know new ones. Before joining Nexus HSE, Scott served as the managing member of ORCHSE Strategies, prior to the acquisition by the National Safety Council, where he served as the Director of the NSC Networks for nearly 3 years.     🙁 As turmoil exists 📉 in the marketplace, how can EHS leaders prepare for a visit from management consultant "friends"? Here are 3 points to consider now 👇 Organizations get pressure to quickly respond when markets or reports fluctuate (inflation, geopolitical/global disruption). This leads to a call for external cost or reorganization "help". Many organizations do not leverage internal expertise when the board or shareholders call actions because "known" consultants provide both a form of cover and board members may have used them in the past. Three things you need to know and what to do now: 1. The management consultant was not hired because your organization believes there are no opportunities. Kind of obvious but understand the management consultant will be looking at industry benchmarks and analyzing your resources vs others in your industry. It doesn't matter if you have better performance (unless you're driving revenue), this is a cost v cost and resource v resource exercise. What you can do - utilize your network to determine staffing and budget levels. Get into a group such as NexusHSE so you can have one on one conversations with your industry peers. This will enable you to understand what the benchmark is and how/why you are different. Without this knowledge, you won't be able to negotiate effectively. You will have to take all consultant information at face value, kind of like flying blind. 2. Most management consultant contracts are savings based. The revenue escalators to the consultant are a function (usually 3%-7%) of total cost savings. This means more savings = more consultant revenue. What you can do - keep a log or inventory of cost savings. This should include cost avoidance, cost savings, and revenue creation. Any direct cost savings can serve as an offering back to the consultant in lieu of resources eliminated. Help them arrive at the conclusion as their own versus saying you "created" this. 3. There is almost a ZERO possibility of "no impacts" if your group is in scope for the financial or operational review. Determine your non-negotiable positions and understand that can't be everything. What you can do - As a leader you should always have a continuous improvement mindset. Even if you don't tweak your organization YOY, you should be thinking how to optimize or expand in a way that generates cost avoidance or savings. This could be the central v decentral model or the internal work v consultant work execution, etc. Understanding this will allow you to be effective at where and what you can eliminate/adjust. Bonus Item - Remember these are not your personal friends, they have a singular mission. Optimize and reduce costs, that is how they get paid. They can have great knowledge and experience, but you know your business too. Treat this as a business transaction not friendship. Good luck.
