Red tape doesn't have to be a stopping point. So before you stop, make sure you really have to. There may be a way to work within the framework it provides. A real life example of this: the United States working with Germany on the Evan Gershkovich release from Russia. When the Germans first received America's swap proposal for Gershkovich's release, Berlin's legal team advised against agreeing to it. But German chancellor Olaf Scholz was amenable to the plan. So, they found a way to work around potential legal issues: America submitted an official request to Germany and went through the appropriate legal and political channels, giving Berlin political cover and allowing the proposal to move forward. Sometimes red tape is an obstacle course, not a stop sign. Pop quiz! ⤵ The answer: it's a trick question completely dependent on context. When trying to build a case for your position, you should NEVER cross the line from professional discourse to personal attacks. They don't work and they'll only embarrass you in the future. BUT when trying to build a professional relationship, it can be helpful to add some of the personal in - get to know them and their background. AND - this is important - if you can't get a satisfactory deal done in the end, see if there's anything you can do for them in another area of business. Your future deals will thank you. #business #businessdeals #businessstrategy #businesstips #negotiation #negotiationskills #negotiationstrategy #negotiationtips #disputeresolution #dealmaking

Do you: A. compromise your interests to get it done? B. walk away, consider the business relationship foiled, and hope you never see the person again? Or... is there another option? Remember: in any industry, you're likely to see some of the same people over and over again. So it's critical to maintain good relationships with them. Not being able to reach an agreement might feel awkward, but it doesn't have to be. Here's a tactic old as time (okay, at least as old as Abraham Lincoln, who we mention using it in our most recent episode): Ask the other side what you can do for them. Not in relation to the deal. But as a person. Just because you can't work with them professionally in this context doesn't mean you have nothing to offer them. Ask them if there's anything you can do for THEM. It's one of the easiest ways to build professional relationships on personal foundations. People want to work with people they like. #negotiation #negotiationtips #negotiationstrategy #negotiationskills #business #businesstips #relationships #businessstrategy #disputeresolution #businessdeals #dealmaking

Have something that could easily derail your entire deal? Tackle it head on. Talking around it, hoping it goes away, or waiting until the end to address one of the most critical parts of a deal wastes both your time and the other side's time. Figure out a creative, productive way to address it, and you'll foster trust, build a relationship, and get a deal done. Ignore it and you're kicking trouble down the road. #negotiation #negotiationtips #negotiationstrategy #negotiationskills #business #businessdeals #dealmaking #businesstips #businessstrategy #disputeresolution #dealbreakers

You know the importance of a chain of command. You know that you need to ensure wires don't get crossed. But have you made sure your intermediaries know who they can and can't speak on behalf of? Do they know how to avoid putting words in your team's mouth? You need to clarify it. If you grant them full permission to speak on your behalf, great. But if you don't, make sure they know how to word things so you don't end up in hot water. #negotiation #negotiationtips #negotiationstrategy #negotiationskills #business #businesstips #businessstrategy #businessskills #disputeresolution #dealmaking #businessdeals

On the podcast, we've talked a lot about the difference between interests and positions, along with the importance of flexibility. But when you DO change a position, does that show weakness? Short answer: no. Longer answer: just like interests are different from positions, positions are different than the principles that serve as their foundation. If you hold true to your principles, changing a position doesn't diminish your power. #negotiation #negotiationskills #negotiationtips #negotiationstrategy #business #businessskills #businesstips #businessstrategy #businessdeals #dealmaking #disputeresolution

Can you ever compromise your positions in a negotiation? SHOULD you compromise them? Will you lose power if you do? This week on S4N, Gene explores the difference between principles and positions through the lens of the US Civil War and the resulting negotiations between the Union and the Confederacy. Learn how to compromise on a position without weakening your negotiating power, explore the dangers of using intermediaries to communicate negotiation positions, and pinpoint why you can't ignore the elephant in the room - even when the topic is likely to polarize it. Plus, talk about how to find common ground and maintain personal connection even when professional agreement can't be reached, and learn the #1 failure of CEOs. EPISODE 16 OUT NOW.
