German competent authorities lodge constitutional complaint against mutual recognition of plant protection products. German competent authorities have taken an unusual approach this week: in their view, too often plant protection products are placed on the market for which the German authorities have safety concerns. The principle of mutual recognition within the EU makes this possible: as soon as a member state grants authorisation for a plant protection product, the other member states must also recognise the authorisation. With the constitutional complaint, the German authorities want to ensure that the European Court of Justice deals with the question of the admissibility of mutual recognition. The legal process of a constitutional complaint is unusual, but also shows that Europe is still a long way from general standards in the safety assessment of pesticides. Legal Precedent Sheds Light on Conflict of Interests in Chemical Management Recent case law has shed light on the challenges posed by conflicts of interest within regulatory agencies tasked with overseeing chemical safety, highlighting the need for robust ethical standards and accountability measures. One notable case that brought attention to conflicts of interest in chemical management is the lawsuit against the U.S EPA regarding its handling of #chlorpyrifos, a widely used pesticide linked to neurological damage in children. In 2021, the Ninth Circuit Court of Appeals ordered the EPA to revoke all tolerances and cancel all registrations for chlorpyrifos, citing the agency's failure to address the risks posed by the pesticide and its reliance on industry-funded studies. Central to the court's decision was evidence of a conflict of interest within the EPA, with several agency scientists raising concerns about the pesticide's safety while facing pressure from industry lobbyists and political appointees to downplay its risks. The court's ruling underscored the importance of impartiality and independence within regulatory agencies, highlighting the dangers of undue industry influence on decision-making processes. Another case that highlighted conflicts of interest in chemical management is the litigation surrounding the European Union's approval of glyphosate, the active ingredient in #Roundup herbicide. In 2019, the European Court of Justice ruled that the EU's approval of #glyphosate was based on flawed scientific assessments and failed to adequately consider its potential risks to human health and the environment. The court's decision pointed to conflicts of interest within the European Food Safety Authority (EFSA) and the European Chemicals Agency (ECHA), where experts involved in assessing the safety of #glyphosate had ties to the agrochemical industry. The ruling raised questions about the impartiality of regulatory decision-making and highlighted the need for greater transparency and accountability in chemical management processes. These legal precedents highlight the importance of addressing conflicts of interest in chemical management to ensure the integrity of regulatory decision-making and protect public health. Efforts to strengthen ethical standards, enhance transparency, and promote independence within regulatory agencies are essential to rebuilding trust and confidence in chemical safety regulations.

After unsuccessfully seeking U.S. Supreme Court review, the pesticide industry has the nerve to push legislation in state legislatures that will shield them from future liability litigation. This is not their first time seeking protection from the states! After the Supreme Court upheld the right of localities to restrict pesticides more stringently than the US Environmental Protection Agency (EPA) and state regulatory agencies in Wisconsin Public Intervenor v. Mortier (501 U.S. 597, 1991), the industry went to every state legislature to seek preemption of their local jurisdictions’ authority to restrict pesticides. [They were successful in putting state preemption laws in place in 43 states and have since added another.] Having failed in the courts, history is repeating itself as pesticide and chemical manufacturers descend on state legislators, this time with legislation to shield them from liability lawsuits filed by people injured from exposure to their products. [So far, the industry has been successful in getting their bill introduced in at least four states.] Let's be clear—legislators who choose to restrict injured parties' rights to seek recompense from pesticide manufacturers are doing their constituents a tremendous disservice. Brazil's Law 14,785/2023 reforms pesticide regulation with mandatory risk analysis and international alignment.
