Brazil’s big regulations news is the passing of Law 14.785 on 28 December 2023, replacing and repealing Law 7,802/1989. After 20 years of discussion in the National Congress, the new law will harmonize standards and improve processes for chemical pesticides. Viviane Kunisawa, Partner with Daniel Law, a Brazilian intellectual property firm, says the new law makes it mandatory to include risk analysis in the registration process. In the past, technical staff would decide if the inclusion of risk analysis was necessary. German competent authorities lodge constitutional complaint against mutual recognition of plant protection products. German competent authorities have taken an unusual approach this week: in their view, too often plant protection products are placed on the market for which the German authorities have safety concerns. The principle of mutual recognition within the EU makes this possible: as soon as a member state grants authorisation for a plant protection product, the other member states must also recognise the authorisation. With the constitutional complaint, the German authorities want to ensure that the European Court of Justice deals with the question of the admissibility of mutual recognition. The legal process of a constitutional complaint is unusual, but also shows that Europe is still a long way from general standards in the safety assessment of pesticides. The Akademie Fresenius online seminar "Regulatory Update 2024 for Agrochemicals" on 21 March 2024 is the perfect place to get an overview of current legal developments for the pesticide industry: https://lnkd.in/egeSPnrq

Viviane Yumy Kunisawa, Ph.D. wrote the article "The New Legal Framework for Chemical Pesticides in Brazil", published on IPWatchdog. Brazil's Law 14,785/2023 reforms pesticide regulation with mandatory risk analysis and international alignment. It introduces the Unified System of Information but faces challenges, including concerns over the Ministry of Agriculture's role and a veto on the Evaluation and Registration Fee. Ongoing discussions and potential legal actions are expected for the law's constitutionality and implementation. Read more at https://lnkd.in/dgKpataP

Daily News: Take Action—Pesticide Manufacturers Ask States To Shield Them from Lawsuits by Those Harmed! Join BEYOND PESTICIDES as we launch a nationwide campaign! After unsuccessfully seeking U.S. Supreme Court review, the pesticide industry has the nerve to push legislation in state legislatures that will shield them from future liability litigation. This is not their first time seeking protection from the states! After the Supreme Court upheld the right of localities to restrict pesticides more stringently than the US Environmental Protection Agency (EPA) and state regulatory agencies in Wisconsin Public Intervenor v. Mortier (501 U.S. 597, 1991), the industry went to every state legislature to seek preemption of their local jurisdictions’ authority to restrict pesticides. [They were successful in putting state preemption laws in place in 43 states and have since added another.] Having failed in the courts, history is repeating itself as pesticide and chemical manufacturers descend on state legislators, this time with legislation to shield them from liability lawsuits filed by people injured from exposure to their products. [So far, the industry has been successful in getting their bill introduced in at least four states.] Let's be clear—legislators who choose to restrict injured parties' rights to seek recompense from pesticide manufacturers are doing their constituents a tremendous disservice. TAKE ACTION TODAY >> Tell your state legislators to protect the right of citizens to seek redress against pesticide manufacturers from harm caused by their products! https://ow.ly/t9jH50QHS4o Daily News Blog Post: https://ow.ly/Slr650QHS4n

Daily News: Lawsuit Settlement Tackles EPA’s Dramatic Failure to Regulate Endocrine Disruptors, Despite Fed Mandate A legal victory in federal court is the latest in a series of attempts to force the US Environmental Protection Agency (EPA) to fulfill the mandate from Congress in 1996 to test all pesticides for their endocrine-disrupting effects and regulate them accordingly. #endocrinedisruption #pesticides #epa The case in the U.S. District Court for the Northern District of California was brought by the Center for Food Safety (CFS) and a collection of agricultural workers’ organizations, farmers’ groups, and pesticide activists. It details EPA’s behavior for over 25 years: a combination of stubborn inaction and a succession of failed promises to do better. After the release of a damning U.S. EPA Office of Inspector General (OIG) report on the agency's lack of progress in protecting the public from potential endocrine disruption impacts of pesticides, CFS wrote: “The 2021 [OIG] report included the shocking revelation that some EPA staff were instructed to function as if the screening program had been eliminated from EPA’s budget, despite a $7.5 million allocation that same year—raising the prospect of EPA’s intentional violation of its statutory duty.” EPA’s behavior is largely inexplicable to the uninitiated; however, it is shaped by the shadowy influence of the pesticide industry, which is like an invisible planet whose existence must be deduced by the behavior of visible objects. In the CFS litigation, CropLife International intervened as a defendant. It is always worth pushing back on egregious environmental failures and it is encouraging to see the CFS settlement set out very worthy goals in writing. But, EPA’s history does not bode well for real change. That will likely require agency restructuring and stronger pressure from Congress. *** BEYOND PESTICIDES' National Forum Series launches TOMORROW at 2 PM EDT! ➡️ Register for all sessions: https://ow.ly/U7Q050TVvOA PLUS, for the second session on November 14 at 1 PM EST, hear from a world-renowned researcher on endocrine disruptors and their connection to petrochemical pesticide exposure: Tracey Woodruff, PhD, director of the UCSF Program on Reproductive Health and the Environment. ➡️ https://ow.ly/6a5H50TVvPr Daily News Blog Post: https://ow.ly/4Caq50TVvPq

Legal Precedent Sheds Light on Conflict of Interests in Chemical Management Recent case law has shed light on the challenges posed by conflicts of interest within regulatory agencies tasked with overseeing chemical safety, highlighting the need for robust ethical standards and accountability measures. One notable case that brought attention to conflicts of interest in chemical management is the lawsuit against the U.S EPA regarding its handling of #chlorpyrifos, a widely used pesticide linked to neurological damage in children. In 2021, the Ninth Circuit Court of Appeals ordered the EPA to revoke all tolerances and cancel all registrations for chlorpyrifos, citing the agency's failure to address the risks posed by the pesticide and its reliance on industry-funded studies. Central to the court's decision was evidence of a conflict of interest within the EPA, with several agency scientists raising concerns about the pesticide's safety while facing pressure from industry lobbyists and political appointees to downplay its risks. The court's ruling underscored the importance of impartiality and independence within regulatory agencies, highlighting the dangers of undue industry influence on decision-making processes. Another case that highlighted conflicts of interest in chemical management is the litigation surrounding the European Union's approval of glyphosate, the active ingredient in #Roundup herbicide. In 2019, the European Court of Justice ruled that the EU's approval of #glyphosate was based on flawed scientific assessments and failed to adequately consider its potential risks to human health and the environment. The court's decision pointed to conflicts of interest within the European Food Safety Authority (EFSA) and the European Chemicals Agency (ECHA), where experts involved in assessing the safety of #glyphosate had ties to the agrochemical industry. The ruling raised questions about the impartiality of regulatory decision-making and highlighted the need for greater transparency and accountability in chemical management processes. These legal precedents highlight the importance of addressing conflicts of interest in chemical management to ensure the integrity of regulatory decision-making and protect public health. Efforts to strengthen ethical standards, enhance transparency, and promote independence within regulatory agencies are essential to rebuilding trust and confidence in chemical safety regulations.

🚨 US Environmental Protection Agency (EPA) Immediately Suspends All DCPA-Containing Pesticides 🚨 The Environmental Protection Agency (EPA) has taken decisive action to protect public health by issuing an Emergency Order suspending all registrations for pesticide products containing dimethyl tetrachloroterephthalate (DCPA), also known as Dacthal. This urgent move comes after evidence revealed significant health risks, especially for foetuses exposed to DCPA. 🔍 Key Points: Effective immediately, all DCPA-containing products are suspended. Studies indicate that DCPA exposure can disrupt thyroid hormone levels in foetuses, leading to potential lifelong health issues such as low birth weight and impaired brain development. The EPA's thorough risk analysis determined that the health risks outweigh the economic benefits of continued DCPA use. 💡 What This Means: The suspension impacts widely used products in agricultural sectors, particularly for Brassica vegetables and Allium crops. Alternative weed control methods and products are available, though they may require more labour and could increase costs. 📢 Next Steps: The EPA is preparing a notice of intent to cancel DCPA registrations within the next 90 days. Stakeholders can find more information and submit comments via the EPA’s official website. https://lnkd.in/eVhsGjgG #EPA #PublicHealth #Pesticides #DCPA #EnvironmentalProtection #Agriculture #SafetyFirst
