REMINDER: The Building Safety Act DOES NOT APPLY to Scotland! Well more accurately 'very few' provisions apply in Scotland but the nature of the press coverage and guidance issued is generally fairly silent on this which can lead to confusion here in Scotland. As this CIOB guidance linked below stated back in February this year, "The UK BSA does not extend to Scotland, however, there are certain elements they need to be aware of such as the amendments to the Health and Safety at Work Act 1974, extended liability relating to construction products, the new architects registration board and the implementation New Homes Ombudsman Scheme. Notably there are not many aspects of the BSA that apply to Scotland including the extension of the Defective Premises Act which currently does not apply to Scotland at all." The APS August update article on the BSA's jurisdiction confirmed, "The Regulator does not have oversight of the Building Control sector in Scotland, Wales, or Northern Ireland." There's an abundance of guidance and web articles out there on this so this post isn't trying to be the font of all knowledge on the very few provisions that do apply in Scotland, but rather just a reminder that the vast bulk of the Building safety Act does NOT apply in Scotland. https://lnkd.in/eVi6zRvG

1 October 2023 is a key date for the Building Safety Act 2022   New concepts introduced such as:   🏦Dutyholders New statutory duties relating to building regulations compliance for any person performing design work or building work. Must appoint a principal designer and a principal contractor. All designers and contractors will also need to demonstrate that they meet competency requirements before they can perform any work. 🛑 Gateways New “gateways” regime will apply for building work relating to higher risk buildings ; “higher risk buildings means those in England which are 18m/7 storeys or more in height, contain at least two residential units or are a hospital or care home.   📰 Building Safety Regulator No work on site before building control application approved by the BSR Existing and newly-completed higher risk buildings (except for hospitals and care homes) to be registered with the BSR from 1 October 2023. Offsite Expo: Supporting Building Safety Standards Coming in the wake of the Hackitt review, receiving Royal Assent in April 2022, the Building Safety Act covers a raft of changes for housebuilders and developers. These include a new system of accountability for safety in projects, a construction products regulator and a refreshed regulatory framework.
