Users of BIMCO’s WINDTIME, SUPPLYTIME 2017 and ASVTIME charter parties should be aware of new guidance relating to possible inclusion or exclusion of General Average and New Jason Clauses. The WINDTIME, SUPPLYTIME 2017 and ASVTIME charter parties do not contain a General Average and New Jason Clause – contrary to SUPPLYTIME 2005. However, this does not mean that general average principles may not be relied upon by one of the parties involved in a casualty as a basis for making a claim in respect of their general average expenditure and/or losses. Stop, and ask yourself: Has my job become routine - done without thinking? Am I ignoring weak signals because 'that is just how things are done around here'? How often do you think, “Have I done enough? What more should I be doing – and what have I missed?” In the industry I represent and work in - if we get things wrong - we put lives at risk with the potential for catastrophic consequences. Hence, at Equinor, how we work with preventing major accidents is central to what we do - it involves asking ourselves tough questions. That is why we start our Annual Safety Wheel with the topic Prevention of Major Accidents. Offering around 40 years of hands-on industry experience, and as 1 of only 61 survivors of the terrible 1988 #PiperAlpha disaster, I was privileged that Steve Rae accepted our invitation into Equinor in Aberdeen to share his story and learnings regarding the safety choices we all make and their potential consequences. Steve discussed the duty we all have in taking safety actions beyond compliance, the role that we all must play in process safety and how easily things can go wrong. Equinor's operations at the Mariner platform are not far from where those 167 souls lost their lives at Piper Alpha on the evening of 6th July 1988. Steve Rae has visited the Mariner platform and engaged with the offshore teams there too. Although our safety culture has hugely improved - not least as a result of Piper Alpha and the following Lord Cullen report - we must never be complacent. Past success and performance hold little information on the future. We must look to continually improve our safety culture and manage a constant sense of chronic unease. At Equinor, we aim to create a culture which applauds individuals who have the courage to speak up and highlight safety concerns. We also believe that everyone has a role to play when it comes to safety - no matter what you do and where you work, with the clear aim of getting everyone home safely, always. At Piper Alpha all that remains above sea-level is a flashing buoy, a reminder of the tragedy that must never be repeated. What is your flashing buoy? Insurance Industry Encourages use of Automated Well Control The insurance industry has a body within it, the Joint Natural Resources Committee (JNRC) that makes recommendations to the insurance industry around managing the risk associated well construction. Due to several recent claims and trends, the JNRC Survey and Engineering sub-committee recently produced a circular, JNR2024-046-Importance of the Well Review: Considering recent Control of Well (COW) incidents, which is linked in the comments below. The document highlights industry best practices and also encourages the use of Automated Well Control techniques. BIMCO issues guidance on General Average and New Jason Clauses for users of WINDTIME, SUPPLYTIME 2017, and ASVTIME charter parties. Not included in these contracts, unlike SUPPLYTIME 2005, parties must decide on inclusion or exclusion based on cargo, property, or equipment involvement in casualties. General average principles still applicable for claims despite absence of specific clauses.

The Weekly Reflektion 23/2024 IOGP has issued Life-Saving Rules (LSRs) and everyone that works in the oil industry should know these and why they are important. IOGP estimate that 376 lives could have been spared in the period 2008-2017 if the people involved had followed the LSRs. Report 459 contaoning LSRs can be downloaded from the IOGP website and of course once downloaded can be used in your organisation. One of the LSRs is ‘Line of Fire’ and failure to follow this LSR is the subject of this week’s reflektion. The basic principle is to separate the person from the hazard. ‘If no one is there, then no one gets hurt’.
