Always remember: the employer is entitled to damages for construction defects 📝 If there's a defects clause and the list of defects is not issued after the set time period (such as 14 days), contractors might argue against addressing defects. Even outside of the set time period, the employer is still entitled to damages. We often see obligations to proceed regularly and diligently in construction contracts. What does that mean? Can the Employer terminate if the Contractor doesn't do this? "n practice, the terminating party will need to justify its decision and it would be wise to ensure that it can be clearly explained and supported by strong evidence.
