This week, we honor and support mothers worldwide by recognizing the significance of breastfeeding for infants' health and well-being and the lactation rights of working mothers. As a law firm dedicated to advocating for employee rights, including employees who are also mothers, we believe it's important to shed light on this topic.
World Breastfeeding Week, observed from August 1st to August 7th, commemorates the Innocenti Declaration made by the World Health Organization (WHO) and UNICEF in 1990. This declaration aims to protect, promote, and support breastfeeding, ensuring that infants receive the best possible nutrition during the early stages of life.
We are grateful for the robust legal framework in California and throughout the United States that safeguards breastfeeding mothers in the workplace. The California Labor Code and the Fair Employment and Housing Act (#FEHA) provide nursing mothers the right to reasonable accommodations, such as break time and private spaces, to express breast milk at work. The federal Fair Labor Standards Act (#FLSA) provides similar protections to working mothers throughout the United States. California laws also prohibit discrimination and retaliation against mothers that assert or attempt to assert their rights to lactation accommodations or for complaining about the failure of an employer to provide this accommodation. These laws play a crucial role in supporting new mothers' physical and emotional well-being, enabling them to balance their professional responsibilities while nurturing their infants.
