Contrary to information previously provided by the CJEU (on the InfoCuria database), it seems that today is NOT the day that an Advocate-General opinion will be published in case C-119/22 (Teva and Teva Finland). An Advocate-General opinion is not the only thing that is missing today. This is because details previously visible on the case record for C-119/22 (namely, the date of the opinion and the identity of the Advocate-General) have been removed. The wait for a substantive ruling from the CJEU on SPCs therefore continues. And it has been a LONG wait. The last substantive ruling was in the Santen case (C-673/18). That was published nearly 4 years ago, on 9 July 2020. This represents the longest period without a substantive ruling from the CJEU since the first SPC legislation entered into force over 30 years ago (on 2 January 1993). There are currently two SPC-related cases pending before the CJEU, namely C-119/22 and C-149/22 (Merck Sharp & Dohme). Those cases have both been pending for over two years, placing them respectively at positions 2 and 3 in the league table of longest waits for an Advocate-General opinion (on SPC-related cases). Unless an Advocate-General opinion emerges before the end of the summer, the wait in both cases will become the longest on record (exceeding that of C-350/92, the application by Spain to annul the first SPC Regulation). It is not clear why the CJEU is taking record-breaking lengths of time to formulate answers to the questions referred in the pending cases. I can only hope that the answers that the CJEU ultimately provides will be worth the wait! #SPCs #patents https://lnkd.in/dgwNKC2K
