It has been very sad and upsetting to read about the experiences of former Harrods staff in recent days. Whilst this scandal is significant given the identity of the accused and the scale of the conduct and cover up, sexual harassment does not only occur in huge businesses run by a supremely powerful owner. It remains to be seen how enforcement of the new duty on employers to take steps to prevent sexual harassment will impact behaviour but stories like the scandal at Harrods (and other high profile organisations) illustrate why it makes sense to impose an obligation on employers to takes steps to prevent sexual harassment. Hopefully employers will take the duty seriously as doing so should greatly reduce the prevalence of such appalling behaviour. #sexualharassment #metoo #discrimination #ukemploymentlaw

POSH ACT,2013 is indeed mandatory in India. It is a comprehensive legislation aimed at protecting women from sexual harassment at the workplace and ensuring a safe working environment. POSH Act’s mandatory nature: 1.APPLICABILITY: The POSH Act applies to all workplaces in India, including government and private sector organizations, NGOs, schools, universities, hospitals. 2.INTERNAL COMPLAINTS COMMITTEE (ICC): It is mandatory for every organization with 10 or more employees to constitute an Internal Complaints Committee (ICC) to address complaints of sexual harassment. 3.AWARENESS AND TRAINING: Organizations are required to conduct regular awareness programs for employees, sensitizing them to the provisions of the POSH Act and the mechanisms available for reporting harassment. 4.ANNUAL REPORT : Organizations must submit an annual report to the district officer, which includes the number of sexual harassment cases filed and their outcomes. This ensures accountability and compliance with the POSH Act. 5.PENALTIES FOR NON- COMPLIANCE: If an organization fails to comply with the POSH Act, it can face serious consequences, including fines. Repeat offenses may lead to higher penalties and cancellation of the business license. POSH is mandatory for all workplaces in India, and compliance with its provisions is crucial to ensure a safe and respectful work environment. PLEASE DON’T IGNORE OR AVOID IT.
