International Arbitration and National Courts: Naftogaz of Ukraine obtains legal order from the UK court recognizing an investment treaty award against Russia Ukraine’s state oil and gas company Naftogaz has secured a court order from the High Court of Justice in London recognising its US$5 billion investment treaty award against Russia over the seizure of its assets in Crimea. The final award was issued at the Permanent Court of Arbitration in The Hague on 12 April 2023. The enforcement proceedings in England & Wales are part of Naftogaz’s worldwide strategy to recover US$5 billion owed by Russia under the award, the largest yet issued in the various arbitrations brought by Ukrainian investors who had assets confiscated by Russia in Crimea. Eltumi Partners’ associate Gofran Abaoub took part in a high-profile conference in London last week focused on energy arbitration and dispute resolution in the Middle East and Africa.   Gofran spoke as part of a panel discussing Energy Arbitration in North African States at the 7th Annual Conference in Energy Arbitration and Dispute Resolution organised by International Law Summits, which took place at the offices of Herbert Smith Freehills.   Her talk encompassed a brief overview of the development of arbitration in the Libyan energy sector, and emphasised the established role it plays as a dispute resolution mechanism.   ICC arbitrations are the preferred forum for energy arbitrations by Libyan energy stakeholders such as the NOC.   Gofran provided a summary of recent developments in Libyan arbitration law, which is based on the UNCITRAL model law, but which remains largely untested in the Libyan courts.   She summarised key developments brought about by the new arbitration law.   Together these lay the groundwork for a more localised arbitration process in Libya; a trend which has already been observed in other North African states such as Egypt. The Guyana Government has taken another landmark step in the modernization of its legislative framework with the recent passage of an Arbitration Bill. This new law enables the resolution of both international and domestic disputes, positioning Guyana as an attractive destination for arbitration in the wider Caribbean and South America. Given Guyana’s rapid economic expansion and the rise in contracts for state and private sector entities, the Arbitration Bill is an important addition to the country's legislative armoury. In under four years, Guyana has rapidly enacted significant legislative reforms that are crucial for the country's development. Some of the progressive pieces of legislation enacted include the Petroleum Activities Law, the Local Content Act, and the Natural Resource Fund Act. They all play a crucial role in not only creating an enabling business environment but ensuring sustainable growth and investment for decades to come. #guyana #development #arbitration #lawreform

🚨 Last week, the tribunal in ENI & Vitol v. Ghana & GNPC held that Ghana’s unitization directives violated domestic law and, as a result, breached the contract’s stabilization clause. 👩⚖️ The tribunal, composed of Gabrielle Kaufmann-Kohler, Judith Gill, and Mohamed Abdel Wahab, also ruled that the domestic court decisions had no res judicata effect in this case. 👇 A framework to understand this decision can be found in my paper on this very topic:
