While this was definitely a significant procedure, her recovery time is pretty quick, around 1-2 weeks max. 💪 However, her boss has told her that she must take a full 12 weeks of FMLA (Family and Medical Leave Act), and they’ve made it clear that it’s not up for discussion! Things took a turn for the worse when my mom walked into her office today, planning to set up an "out of office" auto-reply for her emails. To her dismay, all her personal belongings had been gone through and packed up! 😞 It’s really worrying for her, and I can see that she’s anxious about her job security. Source: https://lnkd.in/gk4kSeSt Is it permissible for my boss to refuse me the ability to utilize an absence for FMLA purposes and resort to guilting tactics to prevent me from taking the day off? Should I escalate these concerns to HR for resolution and support? Here's what happened: As per my FMLA entitlement, I am allowed 1 absence weekly for my existing condition and treatment, up to 3 a month. But after informing my boss an hour before my shift about my symptoms, I was guilt-tripped for calling out last minute. Despite being granted FMLA starting 4/22, my boss implied that my absence affected the team and reminded me of the 2-day reporting policy. This kind of behavior is not just unethical—it’s illegal. Under the Department of Labor regulations, FMLA protects your right to take unpaid, job-protected leave for qualified medical and family reasons, including mental health issues. Employers are prohibited from interfering with or retaliating against an employee who seeks to exercise their FMLA rights. Offering severance or pushing for resignation instead of honoring an FMLA request can be seen as an attempt to undermine your legal protections. If you find yourself in this situation, you may have grounds for a legal claim against your employer for FMLA interference or retaliation.
