Stamp Duty Land Tax ("SDLT") might just be the hidden hurdle that could impact your most cherished investment – your home! Recent news sheds light on its significance as HMRC has recently won a First Tier Tribunal (FTT) appeal involving a disputed SDLT bill linked to a property's residential status. A family were living in their new home – a six-bedroom house with a double garage, an office above, and a self-contained barn with two bedrooms, two bathrooms, and an open-plan living space. The property also has two stables and a two-acre paddock. Despite being in occupation since November 2018, some twists and turns pushed the completion date to January 2019. HMRC determined that the residential SDLT rate applied to the entire property acreage and that the property was exclusively utilised for residential purposes upon acquisition.
