Really helpful overview of the first six months of the UPC from Adam Houldsworth on IAM today. For example, of the more than 100 cases so far filed, 18 are SEP-related. Plaintiffs include Nokia, Huawei, Philips and Panasonic. As Adam notes: "With major SEP owners such as Ericsson, Samsung, Qualcomm and Huawei among the top ten Unitary Patent owners, it is likely that further SEP battles will emerge." More generally, something that will particularly please policy makers is the interest SMEs have shown in the court, with a number also filing suit there. For me, though, the most significant development for the long-term is the interest in the Unitary Patent: over 15,000 applications and more than 14,500 grants since 1st June. "There is now a substantial number of patents that can only be asserted at the UPC," Adam writes. That quantity is only going to grow. Now, if they could sort out the CMS (sigh). Standard Essential Patents - Breakfast Debate 🔒 In 2024, the European Parliament will vote on legislation that will have a far-reaching impact on Europe's ability to innovate next-generation technologies. However, the proposal remains highly controversial, with many unanswered questions about its practical implications. In collaboration with Qualcomm, I will organize a breakfast debate on Standard Essential Patents (SEP) tomorrow in the European Parliament. “Now more than ever” – partaking in today’s FSA event on the SEPs Framework Regulation. It may be a friendly audience for those recognizing that there are serious inefficiencies in SEP licensing in Europe today, but given the amendment overload that the SEP holder side has let wash over the European Parliament, I thought it was a good opportunity to bring all the arguments together again. In the EU, Huawei/ZTE and the Horizontal Guidelines make it very clear that any willing licensee should be granted a license, at FRAND terms. SEPs are not normal patents. The USPTO and the UK Intellectual Property Office (UKIPO) have signed a groundbreaking memorandum of understanding (MOU) to collaborate on policies related to standard essential patents (SEPs). 📅 Date Signed: June 3, 2024 🤝 Key Points: → Facilitate collaboration and information exchange on SEP policies. → Educate small and medium-sized enterprises on fair, reasonable, and non-discriminatory (FRAND) licensing. → Improve transparency in FRAND licensing. → Engage stakeholders to raise awareness about SEP issues. → Explore incorporating additional jurisdictions into SEP-related activities. “Standards touch all aspects of modern life, including video compression, wireless communication technologies, computer connection standards, automotive technology, and more," said Under Secretary Kathi Vidal. This collaboration will benefit businesses of all sizes, fostering innovation and fair competition. The most frustrating element of the whole SEP licensing regulation process is the speed at which it is all happening. The European Commission's own research has made clear there is no urgency: "Existing empirical evidence on the causal effects of current SEP licensing conditions is largely inconclusive. Empirically observable outcomes do not indicate the existence of pervasive “opt-out” from standards-related innovation as a consequence of SEP licensing conditions; i.e. it does not appear that the observed challenges in SEP licensing are sufficiently severe as to systematically discourage potential contributors from participating in standards development, or discourage potential implementers from creating products that use technology standards subject to potential SEPs." So why the hurry? Given what is at stake - jobs, investment, security, innovation - getting it right is what matters more than anything else. Let's take the time to do that. Europe will bitterly regret getting this wrong.
