DIVISION OF MINE RECLAMATION ENFORCEMENT NOTIFICATION The Division of Mine Reclamation (DMR) has issued a notification regarding heightened enforcement efforts under the Surface Mining and Reclamation Act (SMARA) for fiscal year 2024-25. This includes ensuring that mine operators submit updated information and associated fees as required by PRC 2207, with administrative penalties for non-compliance. The focus will be on the 2023 reporting year, and past compliance history will influence penalty assessments. Additionally, DMR will rigorously review and inspect operations that fail to submit adequate and timely Financial Assurance Cost Estimates (FACE) and Financial Assurance Mechanisms (FAM) as required by PRC sections 2736 and 2773. Non-compliance may result in penalties or orders to cease mining activities. For industry outsiders, the concept of mine reclamation is not often apparent. But the truth is that most mining projects cannot go ahead without a properly financed and guaranteed mine clean up plan. The concept is that after the mine ceases to be operated, the property has to be restored to its original form. That sounds simple, but putting arrangements in place many years into the future when the parties to the mine operations and ownership almost undoubtedly will change is complex. For example, do such arrangements survive a company bankruptcy? As the mining industry evolves, alongside the evolution of environmental protection legislation and innovations in reclamation technologies, stakeholders are faced with a myriad of regulatory challenges and opportunities when implementing reclamation strategies. What guarantees that Minnesota's taxpayers aren't left holding the bag if mining companies go bankrupt? Minnesota’s regulators and lawmakers recognized the risk of abandoned mines during the development of the State’s metallic mineral mining rules and enacted regulations to protect taxpayers and the environment. For nonferrous mining, Minn. Rules Chapter 6132.1200 address financial assurance, which applies to all lands within a mining operation, regardless of ownership. Financial assurance requires mining companies to provide money ahead of operating and it must be sufficient to cover reclamation costs, payable and available to the DNR when needed, enforceable under law, not dischargeable through bankruptcy, and approved by the DNR Commissioner. The estimates are evaluated and approved by the DNR on a yearly basis to determine any necessary adjustments. Abandoned mines, most notably in the western U.S., have resulted in a significant burden on U.S. taxpayers and the environment. Citizen concerns about abandoned mines are often based on the impacts of these mining operations that occurred prior to the Federal Land Policy and Management Act of 1976. These regulations define abandoned mines as mines that were abandoned prior to January 1, 1981, the effective date of the Bureau of Land Management’s Surface Management regulations. Today’s mines that are on Federal lands in the US west are regulated by the federal government and have safeguards in place to prevent this situation from occurring again.
