WIPO concludes new treaty to protect genetic resources, traditional knowledge; India plays key role The World Intellectual Property Organization (WIPO) has signed a groundbreaking treaty on intellectual property (IP), genetic resources (GRs), and associated traditional knowledge (ATK). The treaty introduces mandatory disclosure obligations for patent applicants to disclose the country of origin or source of the genetic resources when the claimed invention is based on genetic resources or associated traditional knowledge. The treaty marks a big win for India and the global south which has for long been a proponent of this instrument. 15 contracting parties adopts WIPO Treaty on Intellectual Property, Genetic Resources and Associated Traditional Knowledge. This is the first WIPO Treaty to address provisions specifically for Genetic resources and Traditional knowledge. Under this Treaty, where a claimed invention in a patent application is based on genetic resources, each contracting party shall require applicants to disclose the country of origin or source of the genetic resources. Where the claimed invention in a patent application is based on traditional knowledge associated with genetic resources, each contracting party shall require applicants to disclose the Indigenous Peoples or local community, as applicable, who provided the traditional knowledge. In India, we already have a provision in the Patent Act which works with Biological Diversity Act, requiring applicant to disclose the source/geographical origin of the biological resource used in a patent application. Further, it is mandatory to obtain approval from National Biodiversity Authority, for obtaining a patent grant, if the Biological resource is obtained from India. The signing ceremony of the historic WIPO treaty covering genetic resources and associated traditional knowledge has just begun. The countries are invited one by one to sign the treaty. After 25 years of negotiations, WIPO finally adopted the treaty to prevent erroneous patent grants in the field of inventions related to genetic resources and traditional knowledge associated with genetic resources. The treaty will enter into force after ratification/accession by 15 countries. It remains to be seen whether the sanctions and remedies provided by the treaty will be sufficient to prevent misappropriation of genetic resources and associated traditional knowledge. In just a few days, we will host a 2 week Diplomatic Conference for the proposed "International Legal Instrument Relating to Intellectual Property, Genetic Resources and Traditional Knowledge Associated with Genetic Resources". (The proceedings will be live-streamed from Monday 10 a.m.). This is a historic moment for several reasons. First, a Diplomatic Conference does not happen often. There have only been 4 since the late 1990s. Two years ago, WIPO Member States decided to move these discussions, which had been going on for many years, into this final stage. Incidentally, WIPO currently administers 26 Treaties. Second, in the last 20 years places like Singapore, Beijing and Marrakesh have played host to major Diplomatic Conferences, but it has been some time since WIPO’s premises in Geneva played host to treaty negotiations of this complexity. Third, it will be the largest ever gathering of negotiators and stakeholders at WIPO’s premises in Geneva. Even for our General Assembly, our participants don’t cross 1,000. Over 1,200 delegates will attend, not just government officials but also those from Indigenous Peoples and local communities, civil society, industry and other stakeholders. It has taken 25 years from when these issues were first addressed at WIPO to arrive at this moment. Like all multilateral negotiations of significance, discussions will be intense and tough but I believe that the expertise, pragmatism and collective wisdom of the negotiators will allow us to cross the finishing line as one WIPO family. Success is not just about WIPO, but will also be a strong affirmation of multilateralism. Let me take this chance to thank my many WIPO colleagues – some who have worked for 25 years on this issue, and others in the past few months and weeks, to make all of the logistical and administrative arrangements, as well as the Secretariat support, the best we can. We wish those who are joining us from overseas safe travels and look forward to welcoming everyone on Monday!

Negotiations continued over the weekend at WIPO to forge an agreement on intellectual property, genetic resources and associated traditional knowledge. The proposal discussed would require patent applicants to disclose information on the genetic resources and associated traditional knowledge, if the claimed invention is “materially/directly based” on these. Why is this important? A successful outcome would: · Reflect the pivotal role that genetic resources can play in innovation, solutions to our shared global challenges and creating opportunities for economic development. · Show that intellectual property is here for the good of all, serving as a catalyst for growth and development. · Provide a much-needed boost to multilateralism.
