𝐀 𝐕𝐢𝐞𝐰 𝐟𝐫𝐨𝐦 𝐀𝐟𝐚𝐫 In a recent decision from the Japan Patent Office (JPO), we explore the case of H WORLD HOLDINGS v. REWARDS (Appeal Case No. 2024-1366, Decided on August 6, 2024). The JPO Appeal Board overturned a prior rejection that found conflict between a junior mark featuring the word “REWARDS” and a circled "H," and an earlier registered mark for “REWARDS.” The Board determined that the inclusion of the circled "H" significantly altered the visual appearance, phonetic distinctiveness, and conceptual meaning of the junior mark, thereby dismissing any likelihood of confusion. #trademarkdispute #japanpatentoffice #trademark #courtruling #intellectualproperty
