Looks to be a vanilla local council tender with the usual work types of Planning, Property, Construction, OHS, IR/Employment, General Commercial and Litigation. Interestingly. Annual Report for the past 2 years would indicate a higher than average legal spend for a local council - in the region of $1.5M to $2M. Submissions close 1 October 2024. Good to see Charlie Banner (Lord Banner KC) and Nick Grant’s independent review into legal challenges against #nsips published. The review summarises the position clearly, and makes a number of positive recommendations. Three that stand out for me are: - Recomendation 3 and the potential streamlining of the permission stage in JRs; - Recomendation 4 and the potential for a higher permission threshold; and - Recomendation 8 and the introduction of target timescales in the Court of Appeal. The review should be of interest beyond the NSIP community, but the analysis in respect of challenges to #dco challenges is very interesting. #cmslaw #cmsplanning #judicialreview

"Anshun" estoppel – the risks of waiting Lately, I have been dealing with the doctrine of Anshun estoppel and its impact on ongoing court proceedings. Below is a brief summary of the doctrine and its importance. What is "Anshun estoppel"? In essence, a party can be prevented from making claims which should have been pursued in the former proceedings. The test is one of reasonableness. That is, a party cannot raise an issue in later proceedings in circumstances in which it is unreasonable for them not to have raised such issue(s) in the first proceedings. If it is unreasonable, that party may be "estopped" (or prevented) from doing so, effectively losing the right to make that claim at all. So why is Anshun estoppel important? Unlike other principles, Anshun estoppel can result in a party losing their right to litigate a matter that has never been raised before. It is, therefore, very important to consider, at an early stage, whether there are any potential claims you may ultimately wish to pursue. If you do not pursue them in the course of existing proceedings, there is a risk you may lose the right to pursue them altogether. Here's a practical example: imagine a construction dispute where a contractor, aware of certain contractual breaches, chooses not to address them promptly. Anshun Estoppel might prevent them from later asserting those issues, emphasising the importance of timely action in legal matters.
