The Texas Education Agency has announced proposed amendments to the Commissioner’s Rules concerning the use of restraint by peace officers involving students served by special education services. These changes bring the Rules into alignment with Section 37.0021 of the Texas Education Code which was revised this past legislative session to restrict the use of restraint and use of OC Spray and Tasers on elementary aged students. The proposed amendments to 19 TAC 89.1053 provide that peace officers performing law enforcement duties and school security personnel may not restrain, or use a chemical irritant spray or Taser on a student enrolled in 5th grade or below, unless the student poses a serious risk of harm to the student or another person (See proposed 19 TAC 89.1053(l)). Of Note: Currently, the Texas Education Code and corresponding Texas Administrative Code (Commissioner’s Rules) sections dealing with peace officer restraint of students only apply to peace officers employed by or commissioned by a school district (ISD police) or SROs assigned to a school pursuant to an MOU to provide a police presence. However, the proposed amended rules described above seem to suggest the restriction on use of restraint, chemical irritant spray and Tasers would now apply to all peace officers performing law enforcement duties on school property or at school events, not just ISD officers and SROs.
