HR departments take note: the Carer’s Leave Regulations 2024 will come into force on 6 April 2024. We have known about this new right for a while but we now have the date from which the new right can be exercised by employees. This means that employees will now be entitled to take up to one week of statutory unpaid carer’s leave in a 12-month period to care for, or arrange care for, dependants with long-term care needs. Employees who exercise their right under these Regulations will be protected from detriment and unfair dismissal at the hands of their employer. Leave policies may need updating to account for this new right.

📋Illinois Employers, have you made sure to display the notice about the New Illinois Paid Leave for all Workers Act for your employees? Additionally, have you included the policy in your employee handbook? It's important to ensure compliance with the new law. The Paid Leave for All Workers Act is a new law that took effect in Illinois on January 1, 2024. The law requires most Illinois employers to provide employees with a minimum of 40 hours of paid leave during each 12-month period. The law applies to every employee working for an employer in Illinois, with some exceptions. I've created a "10 Types of Employees Not Covered Under the Act List". Message me for a list of employees who are likely not covered under the Act. *****Not legal advice.****** *Employees are entitled to begin using the accrued paid leave after 90 days. This means the first day employees could take off time that has accrued since January 1, 2024 would be March 31, 2024. 😀 I'm excited to help employees and corporate employers with this law. New Carers’ Leave Regulations 2024 What do you need to know? 👉 Employees are now able to apply for up to one week of unpaid carer's leave per year in order to provide care or assistance to someone dependent upon them who has a long-term care need. The new act came into force on the 6th April, and eligible employees now have a "day-one" right to carer’s leave. What are the employment protections? 👉Employees taking carer’s leave have the same employment protections as those taking other forms of family-related leave 👉Protection from dismissal or detriment as a result of having taken the leave. Today Roxburgh HR bring you a summary on the upcoming LO implementation of Carers Leave. 🔹The Carer's Leave Regulations 2024 are due to come into force on 6 April 2024. The Regulations confirm the key features of the statutory scheme: 🔹Employees can apply for up to one week of unpaid carer’s leave in any rolling 12-month period. This will be a day one right, meaning there will be no minimum service requirement to qualify for the right. 🔹To qualify for the right to take leave, employees must have a dependent with a long-term care need and be taking leave to provide or arrange care for that dependent. 🔹Leave may be taken in full days or half days up to a block of one week and may be consecutive or non-consecutive. 🔹Employees must give notice of their wish to take leave. Employment law changes – any questions? April employment law changes are now in place. There’s a lot for business owners to think about, here’s a quick Q&A summary: Q: How do I calculate holiday entitlement for flexible workers? ◾ Employers can now start using the rolled-up holiday pay calculation again for part-year workers Q: What’s the change to the flexible working statutory entitlement? ◾ All employees now have the right to request flexible working from day 1 of employment. Employers might want to check the intentions of new employees during recruitment to avoid surprises. Q: What are the changes with Paternity leave? ◾ Employees can now separate leave into 2 x one-week blocks instead of taking the two-week entitlement in one go. ◾ Leave can be taken any time in the 52 weeks after the birth or adoption of their child. Q: What’s the Introduction of Carer’s leave for unpaid carers? ◾ A new right from day 1, employees with unpaid carer responsibilities are now entitled to take up to 1 week unpaid leave. This is every 12 months to give or arrange care for a ‘dependent’. It’s worth noting that this is anyone who relies on them for care, not just a family member. The week can be taken in one go, as individual days or half days throughout the year; employees can use the week for more than one dependent if needed. Further rules apply. Q: Are our pay rates still compliant? ◾ Increase to the NMW and NLW to £11.44 per hour ◾ Increase to SMP, SAP, SPP, SSPP, SPBP & MA from £172.48 to £184.03 per week. ◾ Increase to SSP rate from £109.40 to £116.75 per week. Q: Anything else? ◾ There are other changes including an extension of protection during redundancy for those on family leave. Additional employment legislation changes are planned for July and September.
