Last week, I had the honor to be guest speaker at a panel organized by Fenwick & West and the National Advertising Division (NAD) on the topic of "Best Practices: Endorsements and Claim Substantiation" 💡 . I really enjoyed the insightful discussion with Mary Engle and Kimberly Culp. If you missed it, you can find the webinar replay below 📽 . Here's a snippet of some takeaways for in-house counsel who are navigating the world of endorsements and marketing claims substantiation ✏ : 🗒 1) Invest in building trust in your relationships with business partners as that will lead to smoother and more fluid communication; which you definitely need to anticipate risks before they become real problems and provide adequate advice. 🗒 2) Make sure to plan ahead to set aside any required budget, staff & other resources for required backup substantiation (such as user testing or sales data) before the claim is made or published. 🗒 3) It's not enough to have well drafted influencer marketing guidelines / policy and solid contracts, it's key to have effective compliance monitoring programs in place to watch out for any possible deviations, timely address insufficient disclosures and put an end to any affiliate relationships in case of recurrent failure to comply. 🗒 4) Regulators are increasingly strict with "puffery" and superlative, general superiority, "best" type of claims, so be sure to adequately qualify the claim to avoid explicit or implicit messages that cannot be supported with data. 🗒 5) When evaluating marketing claims, be sure to put on the "typical consumer" hat, and assess whether an average consumer would reasonably expect to achieve the results the ad is claiming and what the "net impression" of the claim will be. https://lnkd.in/gU-pwRtm
