#SocialJustice | In Ladakh, a powerful ecological and democratic movement is underway. The people of Ladakh want to reclaim their agency in shaping their future and protecting their lands by calling for the implementation of the Sixth Schedule of the Indian Constitution, which would ensure that decisions related to land, forests, mining, resources, customs, and culture require the approval of the region’s elected representatives and the indigenous communities who are custodians of these resources. However, this isn’t the first time that the people of Ladakh have made such demands. As civil society groups and local communities began to realise the implications of their dwindling political representation, the Climate Fast movement in Ladakh aims to extend far beyond its geographical boundaries. It is a rallying cry for the self-determination of Ladakh—for its environmental, democratic, and indigenous rights. By advocating for inclusive, sustainable development, the movement sends a strong message against the imposition of mainstream development paradigms. It highlights the significance of intersectional approaches to tackling the interconnected democratic and climate challenges globally and in Ladakh. 📣 After action taken last week by the #UN #SpecialRapporteur on #EnvironmentalDefenders under the #AarhusConvention Michel FORST (https://lnkd.in/eCVk_CjG), the #ECtHR refuses to grant an interim measure sought by four persons, known as #LesÉcureuils, occupying trees in protest against A69 motorway project in #Saïx, #Tarn, #France. 🌳 Invoking in particular Article 3 of the #ECHR, the applicants complained about the measures taken by the authorities to dislodge them. They mainly argued that deprivation of #water, #food and #sleep to which they were subjected constituted #inhuman and #degrading treatment. They alleged to be faced with an imminent risk of irreparable harm to their #lives and #health. Having rejected this request, the #StrasbourgCourt has informed the applicants that in the event of an imminent risk of irreparable harm to their rights protected by the ECHR, they can apply to the Court for a new interim measure. 👉 Viard-Seifert and others v. In a significant legal development, the Supreme Court of India, in the case of M.K. Ranjitsinh v. Union of India (2021), has reasserted the citizens’ entitlement to be shielded from the detrimental impacts of climate change. This pivotal judgment, which upholds the importance of Articles 14 and 21 of the Constitution, was delivered by a three-judge Bench consisting of Chief Justice D Y Chandrachud, Justice J B Pardiwala, and Justice Manoj Misra. Want to know why agrobiodiversity #conservation is the first essential step towards #climate resilience? One month after the Forest and Farm Producer Organisations’ International Conference on #Agrobiodiversity in Pokhara, Nepal, co-organized by IUCN, Duncan Macqueen from the International Institute for Environment and Development (IIED), another partner of the Forest and Farm Facility shares his thoughts. ✍ The article identifies three key action points from the conference on how decision-makers can support smallholders and Indigenous Peoples as the custodians of biodiversity: 👩🌾 Recognize the vital traditional knowledge of smallholder farmers and Indigenous Peoples who are crucial for stewarding agrobiodiversity. 💲Disperse international finance mechanisms to empower local groups, learning from successful models such as internally mobilised finance mechanisms run by smallholders themselves. 📃Encourage full participation of farmers in crafting laws and policies that protect Indigenous and peasant seed systems, prioritizing human rights declarations for indigenous peoples and peasant farmers over commercial interests.
