"The authority of the Federal Energy Regulatory Commission to regulate regional transmission planning and cost allocation has long been recognized by bipartisan majorities of the Commission and U.S. Court of Appeals for the District of Columbia Circuit.[1] It could hardly be otherwise. Both regional transmission planning and cost allocation are practices that have exactly the type of “direct effect” on Commission-jurisdictional rates that the U.S. Supreme Court has held brings a matter within this Commission’s jurisdiction.[2] Indeed, our authority to regulate regional transmission planning and cost allocation is essential to the Commission’s ability to ensure that customers have access to reliable, affordable supplies of electricity—our most fundamental statutory responsibility.[3] Nothing in the Supreme Court’s Loper Bright decision overturning the Chevron doctrine calls that conclusion into question.[4] That we have that basic authority remains not only a reasonable reading of the Federal Power Act, but the best reading of the statute, exactly as Loper Bright requires.[5]"

The United States Senate voted today confirming the three Federal Energy Regulatory Commission nominees – Lindsay See, David Rosner, and Judy Chang. EPSA welcomes this decision, with EPSA President and CEO Todd Snitchler stating “We are pleased to see [FERC] restored to a full roster ... It will be essential that FERC works to address wholesale power market barriers to reliability and competitive investment, and support the proven ability of competition to deliver reliable, cost-effective, and innovative grid solutions. Concerns are rising about the future reliability of America's electric grid! House Energy and Commerce Committee Chair Cathy McMorris Rodgers and Energy, Climate, and Grid Security Subcommittee Chair Jeff Duncan have sent a letter to the Federal Energy Regulatory Commission (FERC), raising red flags about the increasing retirements of power plants. With fossil-based generation resources providing 60% of the nation's electricity, regulatory, policy, and environmental pressures are threatening the grid's stability. Changes in costs, planning parameters, and the role of intermittent resources need to be evaluated to ensure resource adequacy and essential reliability services. The letter from McMorris Rodgers and Duncan requests a response from FERC by January 16, 2024. It's a call for action and an opportunity for FERC to address these concerns and provide clarity on their plans for safeguarding the reliability of our electric grid. As we navigate the energy transition, balancing our environmental goals with the stability of our power supply is paramount.
