Title insurance claims payments as disclosed by the American Land Title Association (ALTA) are incorrect. The largest title insurance companies do not accurately disclose in financial statements claims payments. The information being disclosed is the amount collected in claims reserves and not claims payments. ALTA lists percentages of industry market share improperly by separately listing Fidelity and Chicago Title, despite both being owned by Fidelity National Title Insurance Company. On June 22, 2023, ALTA reported that in Q1 of 2023 market share: Top 10 Individual Underwriters by Market Share First American Title Insurance Co., 23.0% Old Republic National Title Insurance Co., 15.5% Fidelity National Title Insurance Co., 12.7% Chicago Title Insurance Co., 12.4% Stewart Title Guaranty Co., 9.6% Westcor Land Title Insurance Co., 3.7% Commonwealth Land Title Insurance Co., 3.3% Title Resources Guaranty Co., 2.9% WFG National Title Insurance Co., 2.4% Doma Title Insurance Co., 2.0% First American Title Guaranty Co., 1.9% ALTA misrepresents that First American is the largest title insurance underwriter by market share. Fidelity National Title is the largest title insurance company by market share at 25.01%. ALTA was contacted about the discrepancies but did not respond.

'Fannie Mae will charge lenders a fee to cover risk under a proposed title waiver pilot program announced by the Biden administration. The program essentially turns the government-sponsored entities (GSEs) into primary market insurers and expands authority beyond their mission and charter.' (American Land Title Association) But attacks on the title insurance industry are nothing new, evidenced by the first sentence of a 2006 @Forbes article titled 'Inside America's Richest Insurance Racket'. The sentence... 'Title insurance firms rake in $18 billion a year for a product that is outdated, largely unneeded--and protected by law.' The Reality? The fact remains, however, that title insurance is protecting commercial and residential buyers in what may likely be the largest financial commitment of their lives!
