According to the annual International IP Index by the U.S. Chamber of Commerce, Italy holds the 9th position among European countries (13th out of 55 overall), boasting an average score of 83.9%. Delving into the specifics, Italy demonstrates strong scores in safeguarding trade secrets (91.67%), patents (88.89%) and design rights (87.5%). However, there remains room for improvement in ensuring copyright (70.14%) and trademark (75%) rights protection. The implementation of EU Directive 2019/790 on Copyright and Related Rights in the Digital Single Market (CDSM Directive), coupled with generous R&D and IP tax incentives, could serve as valuable tools in advancing IP safety.

Is justice served? In today’s high-tech, AI-driven world, access to information is widespread. Yet, we are seeing a troubling phenomenon: unqualified individuals gain positions of power, using their influence and legal maneuvering to unjustly benefit themselves. These leaders often draft contracts that serve only their interests, without regard for fairness or the harm they cause to others. Disturbingly, despite their actions, they receive recognition too, further entrenching their power. Justice, in such cases, is elusive. The legal systems, which should protect fairness and equality, sometimes fall short. Contracts, rather than being balanced agreements, can become tools for exploitation, leaving those without power at the mercy of the powerful. This modern exploitation echoes the days of figures like Al Capone, where instead of brute force, the manipulation of laws is now the weapon of choice. The absence of adequate legal protections for those under such contracts creates an environment where justice remains unserved. The solution must come from reform: legal frameworks need to evolve to close these loopholes, ensuring that contracts are fair and transparent. Checks and balances must be enforced rigorously to protect individuals and prevent abuse of power, ensuring that justice is upheld for all in this complex, modern landscape.
