“A judiciary that markedly fails to reflect the ethnic, gender and social composition of the people they serve risks seriously undermining the public legitimacy of our legal system and the trust of those who use it.” - our Legal Director Stephanie Needleman talks to Catherine Baksi for The Times: https://lnkd.in/ew-Tz3tm #judicialdiversity

At present, gender and caste representation stands at 8.82% of the total judges of the Supreme Court. what we should be questioning is the cherry-picking strategy of judicial appointment. Till 2010 there was a trend of informally reserving one seat for the SC category. This trend came to a halt from 2010-2019. What made the institutions, involved in selecting, realise after a decade that it requires representation from scheduled caste community? how dedicated are their commitment towards building a 'critical-mass' which can change the demographic composition of the apex court? If that happens, how is it going to impact the institutional role of the judiciary?

To guarantee fair treatment and lessen disproportionate arrests and prosecutions, the criminal justice system must address gender prejudice and socioeconomic inequities through training, fair treatment policies, frequent review, and community involvement. I am delighted to announce that the essay I submitted, "Implicatory and Fairness are Essential Tenets in the Criminal Justice System," won position in the PIMR, Department of Law Department of Law article Writing Competition. After that, the piece was selected to appear in the prestigious third edition of Vidhanam Newsletter, the department newsletter. The piece was published in the newsletter on February 20, 2024, under the "Students' Corner" section (Page 3). A just criminal justice system is based on two fundamental ideas, according to the glimpse of the essay: implicatory behavior and fairness. This recognition serves as a powerful validation of the importance of these fundamental principles. I am profoundly grateful for the opportunity to contribute to the vital discourse surrounding this critical issue, and I remain committed to promoting fairness and equality within our legal framework. #essay #newsteller #competition #criminaljusticesystem #Law #Equality #PIMR

Law schools should teach students a little bit about court politics. If you are a first gen lawyer, it is possible that you are completely unaware about it and it can be a bit of a shocker how things work in the courts when you finally find out. In a short course, your law schools can introduce you to this topic; how those who run the show get in that position, how court politics are also dominated to some extent by themes of caste, class, religion etc just like mainstream politics, what are the common obstacles faced by bar associations, why lawyers keep going on illegal strikes etc. Court politics is inherently related to your experience of practicing in a court. Without understanding local court politics, it’s difficult to integrate yourself into a court environment (especially for first gen lawyers). Also, in terms of seeing increased participation of women and queer folks in admin stuff, it’s absolutely essential to understand how things work in the first place so that you can start proposing policy changes as a member of the fraternity. My first brush with this as a young lawyer was long ago when I campaigned for a senior who was contesting for the post of president of the bar association. He didn’t win but the experience was epic! The extent of the rot in the system is completely exposed when powerful lawyers fight for prestigious posts; literally anything can and does happen then. #courts #elections #politics

🚨 FAIR Urges the U.S. Department of Education to Suspend #TitleIX Changes 🚨 Changes to the Title IX rules are set to take effect on August 1st. Today, FAIR's Director of Legal Advocacy, Leigh Ann O'Neill, sent a letter to Secretary Cardona urging him to suspend these changes until all legal challenges are resolved. Since its publication, this controversial rule has been blocked by two federal judges, and injunctions have been issued in 10 states. Public schools and universities are being asked to spend resources to comply with a rule that we believe is likely to be ruled unconstitutional. Earlier this year, the U.S. Dept. of Education published sweeping changes to #TitleIX of the Civil Rights Act. FAIR is extremely concerned about the implications of these changes, including the impact the new rules will have on sex-segregated spaces. #Lawyers are familiar with the term "circuit splits" but the general American public probably is not. When a law suit is lost it may go to the next level which is a Circuit Court of Appeals. At that level it is imperative that the judges utilize #fairness #equality #reciprocity, especially when a victim has proven #sexualharassment, #retaliation and #discrimination #primafacie but her perpetrators #perjured #falsified documents, dates, activities, #spoliated and #misrepresented How do people get away with lying and presenting falsified records and hiding evidence anyway? Each of us require #equaljusticeunderlaw , even #thelittleguys Please help #judges When fairness does not happen, the only choice left is the #supremecourt to demonstrate #circuitsplit and with the help of #amicuscuriae Our students, our kids, our public deserve #safety, #comfort, and #transparency while attending college and university. ⚖ Regulatory colleges and the judiciary in #Canada have lost their way. They have become permeated by political agendas and ideology, and weaponized against registrants and/or citizens. This 📰 gives a good overview of some of the dynamics at play. There is a profound lack of accountability for these institutions and those that make administrative and legal decisions. This is how corruption happens and has become entrenched in #Canada. "If you have a college that regulates who can work in your field, they can now control your political speech and censure you over anything you say in public or on social media. If you haven’t heard, #JordanPeterson has lost his latest attempt to fight back against the College of Psychologists of #Ontario and their attempt to force Peterson into social media reeducation. The College had received complaints about comments made by Peterson on social media and on The Joe Rogan Experience Podcast. All the complaints were political, none involved his work as a psychologist, but he was still subject to a disciplinary hearing and told to undergo social media training in a manner chosen by the college. Peterson said no and launched a legal challenge, seeking judicial oversight of the proceedings and claiming the college was infringing his #Charterrights. In his incoherent ruling, Schabas said that the order by the college was “not disciplinary” even though it was issued by the disciplinary committee and the judge described it as disciplinary elsewhere in his half-baked ruling." https://lnkd.in/g5kH_FmD #Charterofrightsandfreedoms #justice #accesstojustice #A2J

The newest Dear Colleague Letter (DCL) from the U.S. Department of Education’s Office for Civil Rights (OCR) provides examples of how OCR intends to enforce Title VI and how it expects schools to respond to allegations of discrimination based on shared ancestry or ethnic characteristics. In our latest Campus Counsel blog post, Amy Fabiano discusses the guidance and the examples, as well as the steps colleges and universities should take https://lnkd.in/eShxmb4W #HigherEd #Students #Discrimination
