A highly interesting conference organised by ACE-JA Paris this morning on the introduction and management of cross-border civil and commercial litigation when the defendant is resident in an EU member state outside France. Judicial strategy and the management of international civil and commercial litigation are becoming a reflection of the clash of legal cultures. Careful understanding of the choice : 1️⃣ of the applicable law, 2️⃣ of the competent judge, Depending on whether you are : 3️⃣ in contractual matters, 4️⃣ or in non-contractual matters, 5️⃣ or in specific areas (defective products, unfair competition, intellectual property, environmental damage, employment law), And whether: 6️⃣ this is dealt with in your contract or not 7️⃣ and if the provisio in such contract is valid and applicable or not Is essential for businesses at a time of globalisation of relations and digitalisation of activities and services. This clarity helps them to navigate wisely through the intricacies of cross-border civil and commercial relations in divergent legal systems.
