The Massachusetts Department of Energy Resources (DOER) has issued (another) set of emergency regulations affecting the Clean Peak Energy Standard (CPS). In the near term, these changes will reduce the cost of CPS to ratepayers; the longer-term implications are more complex. American Clean Power Association (ACP) filed a petition requesting the Federal Energy Regulatory Commission to convene a technical conference to discuss #capacityaccreditation. ACP urges #FERC to take up the discussion for several reasons: "(1) the absence of clear policy guidance from the Commission, or even an actionable set of first principles as a starting point, has led to a patchwork of capacity accreditation rules across the country; (2) establishing capacity accreditation rules through ad hoc proceedings under section 205 of the Federal Power Act (“FPA”), without meaningful regulatory guidance, poses significant risk of undue discrimination or preference; (3) developing policy in an ad hoc manner may trigger the Commission’s prohibition on ex parte communications, chilling collaboration and regulatory engagement; and (4) properly calibrated and coordinated capacity accreditation policies can have significant benefits in terms of reliability, cost, fairness, economic efficiency, and cooperative federalism." New enforcement outcomes announced each day: Here, Red Energy self-reported alleged breaches and issued a corrective letter to affected customers. Self reporting of potential breaches is a legal requirement. As an aside, do you think that self reporting should mean that a set discount is applied on any penalty imposed? Clearly, compliance is a non-negotiable. Commissioner Symons, emphasized the importance of energy companies meeting their obligations to customers. “We continue to monitor energy companies to make sure they meet their obligations to their customers and uphold the strong energy consumer protections we have in this state. Where we find evidence that an energy company has not done the right thing by its customers, we take action,”  highlighting the ESC's commitment to upholding strong energy consumer protections. #energyregulation #consumersprotection #corporatecompliance
