The Occupational Safety and Health Administration (OSHA) sets regulations to protect worker safety, health, and the environment. However, some of these rules pose challenges for property developers by limiting access to durable, high-quality building materials. For example, current paint regulations result in options that peel within two years, requiring costly and frequent repainting. Similarly, roof vent sealers often fail to provide the necessary protection against water damage, compromising building longevity. LABA advocates for balanced regulations—policies that ensure safety and environmental protection without sacrificing the quality and durability of materials. Together, we can build smarter, more sustainable structures that stand the test of time. The building industry is making strides at becoming more gender-inclusive. Washington state law now requires employers to provide construction workers with additional resources on the job such as safe and clean places to express breast milk, access to hand-washing stations and no-cost feminine hygiene products. L&I is currently conducting rulemaking in support of the law. In the meantime, employers can follow guidance provided in our Sanitary Conditions for Construction Workers product card. It’s been a while since the enactment of the Building Safety Act, bringing with it the Remediation Order and the Remediation Contribution Order regime. More recently, and following a number of applications to the First-Tier Property Tribunal, the Leasehold and Freehold Reform Act 2024 has provided some clarity on matters such as the scope of recoverable costs under a Remediation Order. Our article below considers this in more detail.

Renovations without checking for asbestos could cost you more than just time. WorkSafe ACT have seen several instances of entire properties being contaminated with asbestos due to PCBUs carrying out renovations without identifying and removing any asbestos first. In serious cases this has resulted in other workers being unknowingly exposed and families having to temporarily relocate from their homes. Under the WHS legislation, any PCBU who carries out refurbishment of domestic premises must ensure that all asbestos likely to be disturbed by the refurbishment is identified and removed before refurbishment starts. In the ACT, any property built before 2003 must be assumed to have asbestos. WorkSafe ACT will issue infringements and prosecute in cases of serious breaches. The top priority for any responsible building manager must be to ensure the safety of their occupants. Something that can often be neglected or overlooked is the maintenance and repair of smoke control systems. Failure to do this can hinder evactuation or even lead to tragic consequences. New legislation focuses on competence in regard to those responsible for the building's design, build and maintenance.
