The U.S. District Court for the Northern District of Texas has temporarily blocked the FTC from enforcing its new noncompete rule against the plaintiffs in Ryan, LLC v. FTC. This rule, announced on April 23, 2024, aims to ban nearly all noncompete agreements and is set to take effect on September 4, 2024. Important point re yesterday’s FTC action regarding noncompetes. This ban is not yet the law of the land. If you are a party to a noncompete, yesterday’s action does not render your agreement unenforceable. The rule will go into effect 120 days after it is published in the Federal Register and there very well could (and probably will) be legal challenges. Stay tuned.
