On October 11, 2023, the U.S. EPA issued a final rule to require reporting under Section 8(a)(7) of the Toxic Substances Control Act for Perfluoroalkyl and Polyfluoroalkyl Substances (PFAS). The rule aims to gather comprehensive data on PFAS, a large group of synthetic chemicals linked to various health and environmental concerns. This broad reporting rule under TSCA will impact all U.S.-based manufacturers and is likely to have significant impacts across multiple industries. Manufacturers will be forced to exercise reasonable levels of due diligence to gather detailed PFAS information related to their use directly or with respect to materials being used in their manufacturing operations. Australia: New regulation for persistent organic pollutants (POP) Australia has published a new Proposed chemical management standards for Persistent Organic Pollutants affecting short-chain chlorinated paraffins (SCCPs). The Industrial Chemicals Environmental Management Standard (IChEMS) has been collaboratively developed by all Australian governments to proficiently and systematically handle environmental risks associated with industrial chemicals, all while establishing consistent regulatory requirements for businesses operating throughout Australia. The IChEMS Register is responsible for documenting the environmental management standards for chemicals, which encompass risk mitigation measures designed for specific industrial applications. Subsequently, both the Australian federal government and individual state and territory governments will enact legislation to implement these standards within their respective jurisdictions. The proposed determination involves the inclusion of a specific group of chemicals, as well as mixtures and articles containing these chemicals, into Schedule 7 of the IChEMS Register. Recent news from the USA Environmental Protection Agency (EPA) regarding PFAS and TCE. » "The US Environmental Protection Agency (EPA) has removed an exemption for per- and polyfluoroalkyl substances (PFAS) reporting, requiring companies to submit data on products containing any level of PFAS to the Toxic Release Inventory (TRI) each year." » "The EPA has also announced a proposed ban on all uses of trichloroethylene (TCE) under the Toxic Substances Control Act (TSCA). If this is ultimately approved, it would be implemented in one year for all consumer and most commercial and industrial uses, and phased in over a longer period for the rest." » TCE is highly toxic and involved in serious health risks including cancer, neurotoxicity, and reproductive toxicity, the EPA stated.
