There is a shred of hope that perpetrators of “safety crimes” will be held accountable for their reckless actions. Of course, let me remind you that there are profound safety issues MSHA is allegedly willing to ignore: 1. Less than 1% of miners receive hydraulic safety training. 2. Over 85% cannot pass a competency test in fundamental hydraulics. This applies to sub-contractors as well as miners.

MINE FATALITY – On May 16, 2023, a bulldozer operator died when a spoil pile slid and engulfed the bulldozer he was operating. At the time of the accident, the bulldozer operator was repairing a ramp used to access water pumps in the pit. Best Practices: -Establish and follow ground control plans that are consistent with prudent engineering design for the safe control of all highwalls, pits, and spoil banks. -Examine highwalls, spoil banks, and ground that slope into working areas after every rain, freeze, or thaw before work in such areas. -Stay clear of potentially unstable areas. Correct unsafe ground conditions in the affected area. -Equip bulldozers with two-way communication systems, high strength glass, and an SCSR for breathable air when working on material that has the potential to slide or engulf mobile equipment. Industry Accident Report: Drowning Fatality at Twin States Mine (USA) On August 18, 2023, at approximately 9:40 p.m., Christopher Finley, a 39 year-old section foreman, with approximately 15 years of mining experience, drowned while installing a discharge waterline for a dewatering pump. The accident occurred because the mine operator did not: 1) comply with the approved ventilation plan to prevent accumulations of water affecting safe travel, and 2) conduct an adequate weekly examination of the return air course. An interesting but not surprising article about two companies and a mine supervisor who were fined $1.57 million after a worker was killed. WorkSafe said “All mining operations must have safe systems of work in place to protect workers from hazardous conditions.” As the person conducting a business or undertaking (PCBU), it is your responsibility to provide a safe and healthy workplace, as far as is reasonably practicable, for your workers. A safe system of work ensures that work is being conducted in a manner that is safe and involves no, or at least, as little risk as possible. All too often we’ve found that while there has been investment in safety systems and documentation, there has not been the same level of investment in empowering frontline workers, supervisors, and contractors to ensure all risks are considered and ‘safety as planned’ = ‘safety as done’. It’s not just about developing procedures and documentation; it’s about how these expectations are reflected in the practices on the front line. Do you have a robust process for onboarding and monitoring contractors? Do you know if your contractors have a safe system of work in place? Are the safety standards and procedures in documentation reflected in the practices on the front line? Are you overwhelming workers and supervisors with documentation or empowering them with the right information at the right time? Are your supervisors empowered with information about the current hazards within their work area and what they are accountable for? We believe that a safe system underpinned by a culture which continually seeks to improve workplace health and safety practices must start with transparency of risks, effective communication, and the tools to enforce accountability for safety at all levels.
