We have lots to unpack with this most recent proposal from California legislation but I wanted to share a quick summary as well as my thoughts. The proposal outlined in Senate Bill 1446 to limit self-checkout services in California is positioned as a means to combat retail crime and preserve jobs. However, such restrictions risk stifling innovation and exacerbating issues such as inflation. By imposing limitations on self-checkout, the bill overlooks the efficiency and convenience it offers to consumers, especially during peak times. Some blame falls on a few retailers staffing only one attendant for ten or more self-checkouts that likely stretched resources thin and left room for exploitation. However, mandating a ratio of one attendant per two self-checkouts risks rendering the self-checkout business model obsolete. The optimal solution lies in finding a middle ground that addresses security concerns without sacrificing the efficiency and convenience that self-checkout offers. Lawmakers should heed data-driven insights and industry feedback to avoid overcorrection, ensuring that any regulations strike a balance between security, operational feasibility, and customer satisfaction. While it has secured $3.5 billion in financing and debt reduction agreements from lenders to keep the company afloat through its bankruptcy, Rite Aid said it would accelerate store closures and sell off some of its businesses, including prescription benefit provider Elixir Solutions. Is Government Affairs part of your Asset Protection strategy? If not, it should be. Retailers are striking back at ORC in both traditional and non-traditional ways. Some retailers have begun to leverage public/private partnerships and government relationships to address legislative issues and concerns regarding law enforcement response. In the last few years, I have had the unique opportunity to be engaged in some of these efforts. I've worked with talented people at Walgreens like Sally West, Jennifer Kurrie, Nicole Kralj and Christopher Howes (at Howes Wolf). They have given me opportunities I could have never previously imagined. (Say what? You want me to testify in front of a Senate committee?!) In the Denver Metro area, I see this effort beginning to pay dividends. State and local laws are slowly being strengthened or changed; government officials are allowing us (Retail AP) a seat at the table; and, strategic enforcement efforts are beginning to increase. I can't help but believe this is what the future of retail loss prevention/asset protection looks like. Is this an approach being used within your company? Do you have "wins" that you can share? "The Deleterious Impact Of Organized Retail Crime (ORC)" Organized Retail Crime (ORC) is the large-scale theft of retail merchandise, beyond personal use, with the intention to resell the items for financial gain, and can also include transactional fraud. It is estimated that ORC is an $100 billion problem for US retailers, annually. To help visualize the magnitude of ORC, consider that Americans consume 8 billion chickens yearly. Thus, if each of these chickens averaged a retail price of $12.50 each, in various forms (e.g. fresh, frozen. rotisserie, fried, patties, nuggets, strips, salads, soups, sandwiches, etc.), it would be as if the "ORC wolf pack" is shrinking out and reducing US retail profits by an amount comparable to all the chicken purchased and consumed by Americans yearly. ORC is truly significant, pervasive, harmful, and unacceptable! Working in the field, for the world's largest retailer, I directly encounter some of ORC's practitioners and ORC's deleterious impact regularly, including: -the danger of violence and injury to customers, employees, vendors, and bystanders, and property damage; -increased costs for merchandise, property damage, deterrence, and insurance passed on to consumers; -closure of much-needed stores, reducing the quality of life, opportunities for gainful employment, reinvestment, and philanthropy in high-shrink neighborhoods; and, -losses in sales and profits. In my opinion, much stronger consequences must be enforced from the bottom to the top of ORC rings to ameliorate this loathsome problem. Crime should not pay: our honest customers should be able to "save money and live better," and not have to suffer due to the behavior of brazen ORC practitioners and participants, and brazen shoplifters, who profit from retail theft and fraud. -Maceo D.
