The US Environmental Protection Agency (EPA) has recently ushered in a new era of transparency in Class VI permitting, a move that promises to reshape the landscape of CCUS projects across the U.S.
At Tailwater, we recognize that a defined and transparent permitting process is key to fostering responsible development and ensuring environmental sustainability. This is why we are particularly encouraged by the EPA's latest initiative, the Class VI permit tracker (https://bit.ly/4aIJgWl). This tool provides the transparency and predictability that investors and project developers need to navigate the regulatory landscape with confidence.
Currently, states with primary enforcement authority or “primacy” hold 14 of the 18 total Class VI permits. This includes the state of Wyoming, whose DEQ issued the first three Class VI UIC permits to Frontier Carbon Solutions, one of our portfolio companies, in 2023.
We are proud of the work Frontier is doing in Wyoming to develop one of North America’s first open source, multipurpose carbon storage hubs, and believe the EPA's recent enhanced transparency in Class VI permitting signals a pivotal moment for other CCUS projects, paving the way for expanded implementation across other viable states.
