📣 The Scottish Land Commission has responded to the Scottish Government's consultation on crofting reform, highlighting the opportunity to further develop crofting as a key component of Scotland’s land reform programme. The Commission has welcomed the consultation, which proposes updates to the Crofting Act, emphasising crofting’s vital role in diversifying land ownership and supporting the Government’s broader objectives for land ownership and use in Scotland. The response from the Commission recognises that whilst the current consultation is focused on short-term improvements in crofting regulation and administration, which it is supportive of, there is potential for wider reforms to crofting to unlock further opportunities including access to small-scale land opportunities and affordable housing as well as supporting rural re-population. Barbudans are celebrating a landmark win in their fight to protect their environment! Land defenders John and Jackie have won their appeal which challenged a decision denying them the right to fight a destructive airport development on Barbuda. This is also a win for communities across the Caribbean fighting against the exploitation and destruction of their island-homes. The Privy Council were only called on to answer a specific legal point on standing, however the hearing and the judgment raised alarm bells at the clear lack of transparency and proper enforcement of planning law by the government and their failure to adhere to the rule of law. These are their key findings: 1. John and Jackie have more than sufficient interest given that their village sits less than two kilometres from the runway therefore impacting their environment coupled with noise disturbances and possible contamination of their drinking water. 2. You do not need to be an expert in environmental matters to take such cases, as long as you are a concerned local or have some knowledge you are empowered to take a case. 3. This approach was deemed by the Court to be consistent with the Escazú agreement (Regional Agreement on Access to Information, Public Participation and Justice in Environmental Matters in Latin America and the Caribbean) to which Antigua and Barbuda are a State Party. This is the first time this international agreement has been cited in any Caribbean case. 4. The government’s failure to follow its own planning laws raises serious rule of law issues. To this day the EIAs have not been disclosed to or seen by John, Jackie or their legal team. Today’s win sets a precedent for other communities facing similar challenges. By removing the barriers to accessing local legal remedies the judgment serves to legally empower communities who wish to challenge harmful developments that are destroying their lands and livelihoods. With the standing issue now resolved, John and Jackie are set to return to the local courts with GLAN’s support to halt the airport going ahead, restore the land and challenge other luxury developments. As part of an international delegation convened by Progressive International, we recently visited Crawfish Rock, a Garifuna community situated adjacent to Próspera, a US-owned company operating an ex-ZEDE (special economic zone) on the Honduran island of Roatán. Próspera is currently seeking close to USD 11 billion in compensation from the Honduran govt under the #CAFTA-DR. This claim stems from the govt's decision to overturn the ZEDE law, which had granted Honduran territory to foreign corporations, like Próspera, to establish private chartered cities operating with minimal (if any) regard for labour, environmental, or health regulations. During our visit, members of the Crawfish Rock community expressed their concerns about the detrimental impacts of the ZEDE: "the ZEDE is destroying the beach, the mangroves, and the forest.” Among the critical issues that arise from the interaction of human rights and investment treaties like the #CAFTA-DR is whether and how the relatively greater access to justice provided to "aggrieved" investors by the regime undermines access to justice for impacted communities, like Crawfish Rock. Many young people avoid involvement on restituted land as there is a perception that most of the work involves farming which is associated with those without formal education and a lot of manual labour. However, there are diverse opportunities beyond physical labour. Today is WA Day, a celebration of all things wonderful about Western Australia. Amidst the festivities, it’s worth reflecting on some of the unique rules that keep this great state in order. In the grand tapestry of legal rules and regulations, Western Australia has sewn a particularly unique patch. In this special corner of the world that I call home, it's illegal to clean up after seagulls without a proper licence. Yes, under Section 387 of the Criminal Code Act 1913 (WA), if you dare to remove guano without official permission, you might find yourself spending a year-long stint behind bars. So next time you're out enjoying the pristine beaches of WA and feel an urge to tidy up, remember: leave the guano be, or it’s off to the clink with you! Rules, especially in the workplace, need to be current and make sense. Whether it's mandating the use of hardhats when there are no overhead hazards or requiring workers to don gloves when there's no risk that requires them, it's important to ensure that our rules serve a valid purpose.
