Join us as we reflect on the Institute's history and acknowledge how far we've come. ๐๐๐๐ฎ๐ฏ๐น๐ถ๐๐ต๐บ๐ฒ๐ป๐ ๐ผ๐ณ ๐ฅ๐๐๐๐๐ง On 1 March 1974, the Institute was formed through an order signed by Real Estate Institute of New South Wales (REINSW) leaders Maxwell Sewell, Russell Jackson and Wilfred Ford. Through this order, members of the REINSW whose businesses were situated within the Australian Capital Territory were โaccorded the status and responsibility as members of a division to be known as โThe Real Estate Institute of the Australian Capital Territoryโโ. According to a 2017 article of the REINSWโs Real Estate Journal, this order came in โresponse to requests from Canberra agents wanting to establish their own representative body independent of REINSWโ. EW ESTATES - RICS For sometime I have posted and commented regarding the situation myself and my family find ourselves in as a result of the negligent service provided by a RICS member and also the widespread failings of the RICS. You might ask as others have, why so many months later am I still focusing efforts on bringing the RICS to justice? Well there are two main reasons. Firstly, for many years we have been saving to be able to provide for our Autistic daughters future, but these savings have been wiped out having to be spent on essential building work required to rectify issues that were never reported in the negligent survey we received. Whilst this may be yesterdays news for the RICS and its members, the consequences of the RICS inability to regulate and the subsequent actions of one of its FRICS, will be felt by my family for the rest of our lives. Secondly, I believe that the public need to understand that when things go wrong which they will from time to time, that the RICS will do absolutely everything in its power to avoid any involvement or responsibility whatsoever. We are not alone in our experiences and the current self-regulating model that the RICS cling on to so tightly to protect and avoid external scrutiny must change. The RICS have advised us that they will no longer communicate with us and have also stated that โNo legal duty of care arises between RICS and persons raising concerns in respect of regulatory investigations, and the general rule established in the authorities is that a private law duty does not arise in circumstances such as theseโ and that โit does not have any statutory power to award or obtain any compensation or redressโ. Whilst from a legal perspective what the RICS have stated regarding their duty of care may or may not be correct (time will tell), I would however welcome any comments or thoughts as to whether morally the RICS should make amends for its failures as a regulator.

They attempt in taking over everything, take over whole sectors, industries, countries, peoples but not me or those with me. It was time for me to leave what that became because I am an ordinary Canadian who has pride in Canada and what Canada did in the past! I am just waiting for Canada to get back to doing what made so many proud of Canada for what Canada did in the past and just wondering here if what made Canadians proud is now all in the past? If you love free-enterprise than you will like learning from our Sunday Communication Group. Free-enterprise here with me is where you can land in a new land where there are opportunities and work and you can get hired if you wish to work and you can buy land and build a home and work and raise your family and enjoy the fruits of your work and enjoy and love your family and be safe and secure and the Government minds its own business and that need have nothing to do with you or very little and you can be free to trust your elected officials never having to contact them and trust their fingers in the collective bank account where your reasonable taxes are safe to be spent so you can drive on a road where the potholes are patched before they get to big and run your own free-enterprise business and hire your neighbors son or daughter from down the road and help your neighbors. I grew up in that world in Canada and grew my own business and have reaped the good things from being free in free-enterprise and I very much want that for everyone in the whole world. Sounds pretty simple and nice and one would think it should be a reasonably easy thing to grow, it is, you just have to know how and I know how here in Canada and it makes my world here in business in Canada a truly free-enterprise one and what a nice experience to have! I lived free in Canada all my life because my father walked on the boat that was going to the Big War in Europe with his duffel, he was sixteen, I was not even born, he fought Germans for five years, for my freedom in Canada. No one is ever going to take it from me ever, sorry. Father made me free, I keep me free, keep us here, we keep us free here, God keeps us free here. What do you want to happen in your life that would be good just make it happen if you feel you have tried to and you can't or something is in your way then reach out to me here, make it happen. There is so much good that can happen if people like you make good happen in the world there are lot who are making bad things happen in the world but you can make good things happen and that is all there is really to it. If we let the people doing bad things out number the people doing good things then the whole world loses When we lose free-enterprise to those who form groups to control it and us we lose our freedom to them so don't. 2023 Round Up - January In what was a bumper edition of the publication marking the first anniversary of our relaunch we saw a review of Mulberry Homes Ltd v The Council of the Borough of Barrow in Furness [2023] EWHC 38 a case concerning conditional sale contracts for the sale of development sites provided by Wilson Horne of Kings Chambers. Further, we had an article from Ashley Pratt of 39 Essex Chambers, considering how the courts should interpret service charge provisions in a commercial lease in the Supreme Court decision of Sara & Hossein Asset Holdings Ltd v Blacks Outdoor Retail Ltd [2023] UKSC 2. Other cases considered included Hudson v Hathway [2022} EWCA 1648 which deals with constructive trusts and whether an exchange of emails can amount to a disposition under Section 53 LPA (Local Planning Authorities) 1925 and James Ballance of Maitland Chambers provided a review of Dixon v Crown Estate Commissioners [2022] EWHC 3256 and the complexities of vesting orders flowing from company dissolution. Robert Kelly of Stewart Title provided a useful exploration of Philpott v Bovisland Park Ltd [2022] and Von Hogersthal v Boyan [2022] and prescriptive easements. Sarah Thompson-Copsey who tirelessly and regularly produces case reports looked at Rail for London Ltd and TTL Properties Ltd v London Borough of Hackney [2022] EWHC 2929. Itโs General Election week!!! A bellwether for a thriving economy is an active commercial property sector that is attractive to investors at the recent commercial property roundtable that was hosted by Brady Savage-George and Almeda Facilities Ltd it was interesting to hear from Hollie Ruddle from Avison Young โUK and Ian Lambert from Hartnell Taylor Cook, who both said that although investment levels into the Bristol commercial property sector had been lower than usual in the past three years, there were optimistic signs going forward. Hollie and Ian were both buoyed by a recent trip to MPIM, where investors were talking keenly about the Bristol City region. Another trend that is happening is the continued influence of family offices in sparking commercial property deals across the region. This is our third key takeaway from a productive morningโs discussion at our most recent roundtable that included โ tag in all guests.
